Expedite request due to terminal cancer

Hello.

 

My 77 yo mom about a month ago was diagnosed with stage 4 breast cancer metastasis to the bones + she has severe ascites going on. She filled I 130 for her unmarried son and would like him to come because doctor’s prognosis not that positive. She lost about 15kg in the last 2 months and weigh 35kg. She cannot eat, even with prescribed medicine.

What’s our chances to get her son in here so he can be with her last days?

 

I am devastated and lost.
 

I am her daughter and have myself 8 months old baby and not able to help her by myself. 

If anyone knows how can I expedite his case or somehow help him to get into here, please let me know.

There is currently nothing to expedite and will not for many years.

 

Best bet is to visit, can he do that?

According to USCIS it’s falling under humanitarian reasons for expedite.

 

Just wondering if anyone actually had a luck with it.

What country is your brother citizen of? Can he come on ESTA or visitor's visa? When was I-130 filed? Is mom a GC holder or US citizen?

Having indicated immigrant intent by  the filing of the I 130, a tourist visa

 is unlikely especially as there was a denial prior to the filing. The i130 pretty much confirmed the officers thinking. You could try applying for a visitor visa with documentation from her dr regarding her terminal condition. I don't know how that would be assessed but i see no no other options

I’m so sorry to hear of your situation, but an expedite isn’t going to help. Even if you can expedite the I-130 with USCIS, there is still no visa available by law as the Priority Date isn’t current. 
 

I agree that trying again for a visitor visa using proof of your mothers situation may be the only option for him to see her. I assume she can’t travel to your brother? 
 

And I’m sorry to sound insensitive but would your brother still want to move to the US if his mother was no longer there and if so, have you petitioned him too as back up?
