Hi, 

i am here in the US with a pending i-130. I just turned 21yrs old. I am allowed to stay here until June 22. Can I apply for F1 visa with a pending i-130? 
i am planning to extend here longer since my dad was also diagnosed with stage 4 cancer. But I think if I apply for visa extension, it might get denied. 
also, will my B2 visa get revoked if the F1 don’t work out? 
also, I am from the Philippines

F2b PI well people who applied 13 years ago are just getting to the front, it will be a lot longer for you.

 

So what is the plan?

 

F1 well depends on the nature of the application, I assume you are able to show you have the funds, you completed your Bachelors. Most importantly what you propose if successful gets you status not a visa.

  Applying for a B2 extension is extremely risky.  You could easily lose the B2 or even accrue a 3 year ban if you overstay 6 months if denied.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I can’t see how your F1 would be approved, as it’ll be obvious you have immigrant intent. You can try but be prepared for it to be denied.

 

As advised in your last thread, forget the B2 extension. 
 

Just checking but you’re aware that (as @Boiler said) you’ve got a really long wait ahead of you (assuming this is the I-130 that’s only just been filed by your Mom). 15+ years probably. A B2 or F1 isn’t going to bridge the gap so you may be better off just going home before June and then visiting regularly (but not too regularly!) on your B2, rather than risking getting a visa denial on your record and not being able to come back at all.

Depending on the details I am more positive about a F1, if it is legit and makes sense.
