ok....so here goes

 

met my wife 2018, applied for k-1 august of 2019

 

she was set to come here from philippines may/june 2020......then covid happened

 

i then could not see her for 2 years and it was a tough time

 

FINALLY she arrives march 2023.....as they pushed my case back because they said people with health problems skip line ahead.....ok....fair enough

 

we get married april of 2023....my lawyer by now took off with all my money and he is being disbarred....still doesnt get me back my money and time wasted and mistakes made on my paperwork hindering me

 

finally submitted everything to adjust status and USCIS keeps asking me for info and i send it over and over again and even uploaded it to my account

 

finally awaited final decision this month and a few days ago i received letter that she was DENIED.....and to wait for another letter of instructions to follow

 

and she got some notification urging her to self-deport to 'make america safe again"

 

we are not criminals, we done nothing wrong, i have a few parking tickets and traffic violations thats it

 

i been on this journey since august of 2019 and we did things "the right way" and spent alot of money doing so.....she wants to go back and visit family but its impossible for her to come home if she does

 

how long and expensive is an appeal? and is she in danger of deportation? she works hard pays taxes and contributes more here than many americans i know.

 

i did contact another lawyer and will probably go broke paying them......is there anything else i can do?

It will depend on the reason for the denial. Is the notice on your online account or do you need to wait for it to come via mail?

If her I-485 was denied, yes.  If she got a letter, she is on their radar. If her employment authorization was tied to her I-485, it will be voided along with the denied I-485.  As @appleblossom said, everything hinges on why she was denied.  The cure could be as simple as refiling a proper I-485 (with cures).  But, she would also need a new I-765.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
