Hi All,

 

Please I am needing any assistance/input as I received an RFE to my proposed endeavor as an Information Technology (IT) Security Analyst, which is really over whelming to me. My 3 work title experiences are as follows

Internal Control and Compliance Officer, AML(Financial Crime Expert), Third Party Risk Management Assessor.

 

USCIS wrote;

 

"Your endeavor lacks specificity, it appears to shift between entrepreneurship and analyst. Your proposed endeavor involves a variety of divergent and unspecified services, in addition to operating your own business. You did not explain how you will divide your time between the various facets of your proposed endeavor. Without these details, you obfuscate the endeavor's prospective impact and prevent USCIS from determining whether it is of national importance."

 

At some point, USCIS also wrote that "my work experience is not similar to my proposed endeavor, and you did not provide evidence of a record of success."

 

Now my question is can I in response to the RFE change my proposed endeavor from IT Security Analyst to "Control and Risk Specialist"?  

Secondly, please can anyone help with the first issue?

2.0 MY PROPOSED ENDEAVOR.

My proposed endeavor as an Information Technology (IT) Security Analyst will focus primarily on protecting organization systems, networks, and data from cyber threats. I will work to solve Information Technology Security problems on cybersecurity issues such as ransomware attacks caused by identity theft, digital literacy, phishing emails (Business Email Compromise), and awareness efforts that have a global impact, beginning with underserved rural areas within Colorado State.

 

Such rural areas are facing challenges such as limited access to resources, lower investment in IT infrastructure, fewer skilled cybersecurity professionals, and less access to education and training programs. These challenges often affect rural areas with smaller economies. I will outline my proposed endeavor in the following paragraphs.

 

My focus will be to embark on a groundbreaking endeavor as IT Security Analyst/Consultant with global implications starting with underserved and economically depressed areas of Colorado State with special focus on the three areas mentioned below.

 

·         As the IT Security Analyst/Consultant, I will serve as the “Threat Intelligence and Information Sharing Expert”.

·         My work will involve “Continuous Identifying Emerging Risk”.

·         I will be responsible for “Client IT Security staffing, Capacity Building and Cybersecurity Education”.

 

2.1 As a prospective IT Security Analyst, I will be the Threat Intelligence and Information Sharing Expert.

 

 

2.2 Secondly, I will be responsible for identifying emerging threats.

 

 

2.3 My third responsibility in the economically depressed and underserved areas of Colorado will be capacity building and cybersecurity education.

 

 

So because of this issue, the 3 prongs were all triggered.

 

Please assist.

I am in Colorado and know a lot of people in IT, for a variety of historical reasons IT is big business here.

 

Where are the underserved areas?

 

What is it that you are proposing that is in the National Interest?

 

Most importantly what does your Lawyer say?

Yep, this is one for your lawyer. If you don’t have a lawyer then that would explain why your case is weak - so get one asap! There are many visa apps that I think can be done without a lawyer, EB1/EB2 are not among them.
 

We used Fragomen for ours and would recommend them.

Hi Boiler,

 

They were mentioned within the various sub headers, but I didn't copy everything to paste over here. I mentioned Fremont County and Wheat Ridge and also gave instances of the type of ransom attacks they faced.

What I am proposing that is of National interest is Identifying and addressing potential security vulnerabilities, monitoring and investigating security incidents, and implementing robust security measures to defend against cyber threats.

I engaged a lawyer that wasn't so helpful, so I got connected to a friend that already had an approved similar case to help out.

I would check them out and see what they say.

I think your biggest problem is that you don’t seem to have any experience in the field according to USCIS, which would make you ineligible for the visa. 


I’d also suggest you answer the questions posed in your previous thread. They really are important, particularly if you don’t have a lawyer.

I certainly did not check them all but just looked at how many cyber security companies there are in the Front Range, over 200.

 

I would question your Business Model, Wheat Ridge is essentially a suburb of Denver and I always think of Fremont as Prisons, unfair but. How would you attract customers where there is such competition.

 

When I lived in Boulder County it seemed half the people I knew were in IT, and now I am in the Boonies  but Denver is not that far and easy enough for Front Range companies to cover.

 

There are a few specialist Lawyers who offer a money back guarantee. This is subjective but it seemed for a while that anyone and everyone could go the NIW route, I think I would have had a case, seems things have returned to actually having a strong case.

I have answered all the questions in the previous thread. Maybe you did not see it. This is my experience/job titles; Internal Control and Compliance Officer, AML(Financial Crime Expert), Third Party Risk Management Assessor. So, without doubt I have experience in the relevant field.

I am needing some insight on how to restructure my proposal please. I was told by USCIS that if I could provide additional evidence in the 3 prongs, then may be my proposal would be approved.

Oh, that is a different thread and I got response from different source. That has already been resolved by my lawyer back then, and USCIS did accept the i765 application and also has sent me a receipt notice. I wanted to know if I could apply for i765 under NIW and yes, I could and I did. Thanks. Please if there is any other question/concern, let me know. But for now, I am beseeching for insight iro the RFE.

As said above, for the RFE you need a really good lawyer. This isn’t a DIY situation IMO.

 

But the main question was about your current status in the US, which is relevant to this thread as well.

Yes, the question/concern is you refuse to fill out your timeline and refuse to indicate what your current status is (or, perhaps, isn't) in the US.  

 

Agree with @appleblossom - this isn't a DIY response to the RFE@Boiler has already provided insight as to why it's not a DIY and why a lawyer is in your best interest.

Sorry a bit busy today.

 

"Adjustment of Status applicant (i130) – pending Form I-485 (previously B-2 visitor visa)." 

 

This is my current status which I believe I also shared in that previous thread. Maybe I was not understood. Or maybe I didn't explain it well.

Presently I have double application running concurrently. Maybe that's what's causing the confusion. Please anymore ask.

 

I have seen the timeline request just now and I don't think it was in the previous thread. I will attend to that later.

But thanks all for the input. I am still open to more....
