Is It Safe for Greencard Holders to travel outside the US?

My wife is a CR1 visa holder from Russia and greencard holder. Her daughter also has her greencard. They immigrated in August of 2024. They want to visit their home country this summer. They'll be gone about 3 months. I will travel with them outbound, but return early. The two of them will return in August.

 

I see a prominent immigration attorney discouraging greencard holders from leaving the US. Is it a bad idea to for them to leave the country right now?

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Sounds like he is emphasizing extreme cases such as excessive absences outside the US.  Why would your family be at risk?

They shouldn't be at risk and we have made plans to make the trip. I just wanted to check here to see if I was missing something.

I would also add that, imho, some immigration attorneys use fear to generate business. I would evaluate what my real risk factor is.

If neither your wife or daughter are in removal proceedings, neither have a criminal record or charges pending and they return in the 3 months that you indicated, IMHO the risks are very low. I also agree with @Crazy Cat with these Social Media lawyers fear mongering. Admittedly, I am biased against immigration attorneys. I have seen 3 different lawyers royally screw up 3 friend’s cases. So take my rant about them with that knowledge in hand.  :)

Jim specifically doesn't file visa cases and says all the time he'd have no capabiltity to help anybody detained by CBP. I think he's geniuinely convinced by what he's telling, probably watched / read too much from certain media outlets.

 

OP's family has no red flags I'd be worried about.

the plus of being a green card holder under the spouse visa is that u can travel home for visits or to settle affairs there after US POE

unless you violate US laws

Permanent residents are free to travel outside the United States, and temporary or brief travel usually does not affect your permanent resident status. If it is determined, however, that you did not intend to make the United States your permanent home, you will be found to have abandoned your permanent resident status
