Hello VJ, 

 

My wife (naturalized USC) petitioned on an I-130 to bring her 30 year old (now) daughter to the U.S. from Thailand. 

Receipt date is 12/26/2020. I think that puts her in the: 

FAMILY-SPONSORED PREFERENCES

First: (F1) Unmarried Sons and Daughters of U.S. Citizens:  23,400 plus any numbers not required for fourth preference.

category ?

 

If this is true, according to the April Bulletin, they are on 2/08/2015 (Feb 8 2015) applications. If so, does that mean they at least as of right now, she can expect at least 6 more years of wait for any movement ? I have asked about this before but I still don't exactly get it. I am not sure if I understand the categories and the Visa Bulletin correctly. Thanks in Advance - Tango

Yes, that’s exactly it. Her Priority Date (date of receipt of application) must be before the date on the Visa Bulletin for her to be eligible for a visa. I’d assume more than 6 years though, as it’s not linear and tends to move more slowly. So for example, if you go back 5 years to April 2020, the date was January 2014, so its only moved 13 months in five years. 

 

Just bear in mind that If she gets married in the interim then she’ll move in to category F3, so it’ll take even longer.

Just checked and no idea which Visa Bulletin you’re looking at, but it’s not the April 2025 one. That’s here - https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2025/visa-bulletin-for-april-2025.html

 

And the date is March 2016 for that category, so a little better, but it’s still only moved 2 years and 2 months in 5 years. So probably at least another decade to go, but just keep an eye on the Visa Bulletin each month to see how/if it’s progressing. Does she have any children that may be at risk of aging out?

Movement is not linear.  Those dates on the Visa Bulletin can move in either direction or remain static. The date for that category on the May 2025 Visa Bulletin did not move from the April VB date.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thanks everyone for valuable info. Indeed I was by accident looking at the April 2024 VB. She does have a 14 YO son who we want to come with her. 

 

I am curious if I am reading this correctly - FA2A Spouses and Children of Permanent Residents are 6 years ahead of 

(F1) Unmarried Sons and Daughters of U.S. Citizens ?

 

Am I not reading this correctly, how could non-citizen sponsor cases  be 6 years ahead of USC sponsors?

Different categories....Different maximum cap for number of visas......different number people already waiting in line.

How long did their I-130 take to be approved? Hopefully a long time, so he may just qualify for a visa still once their PD is current.

As @Crazy Cat said, different categories. You’re comparing a category for adult children aged 21+ to a category for minor children.
 

F2B is the category for adult children of LPR’s, and that’s a similar wait to F1.

My guess is that she will qualify, weel who knows what she will want to do by then, not anything you can do about it, diary for 2030 and see how things have moved.

Yes, I realise that, and there’s a chance he’ll age out. Hence the question about how long the I-130 took to be approved - you can add that on to his age for CPSA purposes i.e. if the I-130 took 3 years (just as an example) then he can still get a visa up to his 24th birthday.
