Got married 12/31/2006.

Contacted US Embassy about requirement for spouse visa; January 2007.

Advised by the Embassy that due to the changes, they no longer can accept I-130.

Advised by the Embassy to file with USCIS. I have all the emails send to me from the Embassy.

Forwarded all required document to family member in US to mail to either USCIS

Or NVC.

3/14/07: I-130 accepted by USCIS

6/01/07: Case approved and forwarded to NVC

7/17/07: DS-3032 and AOS accepted by NVC

8/06/07: Mailed IV bill

8//13/07: Mailed I-864

Since our marriage, I have been living with my wife.

I have a permanent resident in US, all my financial document send to NVC

shows my resident address in US.

My questions:

Form DS-230, line 14:

Address of spouse (if different from your own). Should my wife put my US address

OR local address?

Interview concern:

Should I be concerned about living overseas and filling with USCIS?

I can't help you with the address question, although I would be inclined to put the overseas address for your wife as that appears to be the truth.

Unfortunately for you, the embassies began again accepting the I-130 about a week after you filed. That would have saved you time because you would have been able to skip the NVC step. However, it is no problem in the interview that you filed through the USCIS. And in some countries you may not have been eligible to file in the embassy anyway if you aren't actually a permanent resident or citizen of the country. We were not eligible to file in the embassy in Israel because I am a student here, on a student visa.

Your wife does not live in the US, so you would not list her address as the US.

Your living overseas during the process is a problem only to the extent it impacts you ability to qualify as the sponsor. It is a positive factor in showing evidence of bona fide ongoing relationship.

My impression is that the question is asking where you are presently residing, which would be at your wife's address since you've been there 7-8 months now and intend to stay there until your wife has her visa and is ready to come to the USA.

It sounds like you have maintained your permanent residence in the USA and should have no trouble documenting that should the question be asked.

Does it impact his ability? He didn't say if he was working over there for an his American company or not.
