Hello!

 

I am planning on filing under the 3 year rule since I am 6 months past the minimum amount of time required. It feels so deceptively easy. Do I basically update everything I sent in for my i751 packet? Do I need to prove that I provide support for my 2 kids that live with myself and my wife? (Do I check yes or no?)My selective service number doesn't link to my ssn but I am over 27 so does it even matter? My wife was born in Canada to 2 US citizen parents, so other than her birth certificate and passport do I have to provide more evidence?

Anecdotal, but my wife and I also found this the easiest process compared to K1, AOS and ROC.  We are not sure, but I believe it helped that my wife had her I751 pending when she had her N400/I751 combo interview.  Since our IO in Detroit had my wife’s I751 package in front of her, and I was also present supporting my wife, the IO did not ask for any of the marriage information my wife had with her (back in 2018, there was no requirement to upload all that information, it was only required for the interview).  Also, the IO conducted a very brief, less than 5 minutes, I751 interview with us to verify the I751 info, and update any info from the filing date about 1.5 years earlier.

 

Overall, your plan seems solid, you should be fine.  Just a note, Detroit moves pretty fast, so when you do get your interview notice, if the I751 is still pending, upload a note requesting a combo interview.

Don't take it too lightly, after all it's the biggest immigration benefit. But yeah, seems like you're doing everything right.

 

 

Ok awesome thank you. I have seen your response on this before but it is still super confusing. Since I have had 2 kids with my wife and they have only lived with us do I say that I support them? Its really confusing

Oh great! My IO is in detroit as well! I brought so much evidence to my AOS interview our officer saw my bags of evidence and said "I'm good" :). I have the note requesting a combo interview all ready to go now as well thanks for posting about that

I interpret "support" as child support, which is only applicable if kids don't live with you due to divorce etc.

I found this a bit confusing too when I completed my N-400. What I did was include a note linking back to this section saying that my son has lived with me and my wife (his mother) his entire life, and I support him through contributions to the household finances, and caring for him jointly as a couple. I think I uploaded a bank statement showing that I was putting my wages into the joint account I have with my wife, just to be cautious. No need to go overboard though, because if you are all living together, this particular section isn't really relevant, but still included.

 

In my interview, I was asked who lived in my household. I told him it was me, my wife, and my son, and he had no follow up questions.

Right, I think the right answer is N/A in this situation. Answering "yes" and saying you live together or "no" (because child lives with me, I don't pay child support) is probably going to have a similar effect. Saying "yes" maybe perceived more positively in eyes of some officers.

By the N400 instructions it seemed to us that the evidence of support only applies to children who do not live with you or for whom support orders exist.  If they are living with you, that fact alone is proof you support them.  We selected "resides with me" and checked "Yes" for providing support for the child, and left it at that with no further evidence or commentary since it seemed not to apply.

I worked from 2022 to 2023 so I think I will upload statements from that time period then state that I stay home to take care of both kids. I had to quit my job to take care of my youngest so I definitely am providing support
