I'm so tired of this process. I double check everything, and then we get a freaking RFE. So the RFE is for:

'Based on the documents submitted, we could not determine that the petitioning sponsor on Form I-864, Affidavit of Support, is qualified. In order to be a qualified sponsor, the petitioning sponsor's Form I-864 must be properly completed and signed, and the supporting documents must establish that the petitioning sponsor's income meets 125 percent of the federal poverty guideline for the sponsor’s household size. See Form I-864P for information on the Federal Poverty Guidelines.' 

What we submitted with the 864 is:

·       Form I-864 - Affidavit of Support, under Section 213 of the INA (Signed by Sponsor) 

·       Proof of my US Citizenship (Copy of Passport Biographic Page) 

·       Copy of my W2 for 2024 

·       Copies of my IRS transcripts for the previous tax year - 2023 (5 Pages) 

 

What am I missing???? I am just completely clueless and I don't know where it went wrong. I tried so hard to make sure everything was perfect and ofcourse we get a freaking RFE.

hmm

the only thing i can think of would be something to back up the W2?

like 6 months of pay stubs and an employment authorization letter

thats what i included (along with the 2023 tax transcript) and as of now we haven't gotten any kind of RFE for the I-864

 

has taxes for 2024 been filed and accepted yet?

He filed them like last weekend, so I'm not sure if it's been accepted.. I'll ask though. Should I add the paystubs and the letter if he has filed those?

if he did it electronically it should be pretty quick

he can check wheres my refund - https://sa.www4.irs.gov/wmr/ or the IRS2Go app. I find the app to be more accurate, as for me the app shows mine have been received, but the website doesn't show anything.

 

also triple check over your I-864 to make sure everything matches up. i.e. the numbers from the tax transcripts and W2 match with what is on the I-864. seems that is a big reason people get RFEs for the i-864.

 

I personally would, unless you can provide the most recent tax transcript. But if it hasn't been accepted and processed yet thats not really your fault.

 

just make sure both the pay stubs and EAL are most recent as well. so EAL would need a recent date on it imo

 

someone else (maybe who has also gotten an RFE and no issues after) might be able to say what they responded with

He's sending me all the transcripts rn, it did get accepted. Do I need account or return transcripts?

We have seen quite a few RFE's when I864s combine IRS transcripts with W2s/1099s.  For some reason when USCIS sees W2s/1099s alone they want to also see the tax return copies despite the fact that IRS transcripts are already included.

I would've added those if the taxes were filed already, which in January (when we first filed) they hadn't yet.. It sucks they do that!

Yes, it seems counter-intuitive considering what was submitted.  What exactly is the RFE asking for?

Ok... so reading the RFE, my suspicion is that it is a combination of a couple of things. As @Dashinka indicated above, there have been examples of people getting RFEs for submitting tax return transcripts along with W-2s/1099s. My big question for you guys is, in part 6, item 7 "My current individual annual income is:" What did you base this number on if you did not submit pay stubs or an employer verification letter?

I don't even know what he based it on. He filled in 39k and it ended up being 42 something. I guess he .. guessed?

Ok so this number needs to be factual and needs to have evidence backing it up... Take the gross earnings from a pay stub and multiply it by the number of paychecks received in a year (26 if paid every other week, 52 if paid weekly, etc.) Then back this up with copies of paystubs (the most recent 6 months as per the instructions on the I-864)  Re-do the I-864, base that number on what the paystubs show as the current income, put the correct numbers in for the total income for the tax returns and include the tax return transcripts with no W-2s or 1099s. Include the required proof of citizenship, make sure household size is correct and come back here for any questions.
