Hello, I need help with my CR1 visa case at the NVC stage.

 

The NVC has rejected my birth certificate and my daughter’s birth certificate twice. We are both Tunisian citizens, but I was born in Libya and my daughter was born in Serbia.

 

We submitted our Tunisian birth certificates with certified translations, and they were also authenticated by the Tunisian Ministry of Foreign Affairs  However, the NVC still rejected them.

 

Do we need to obtain birth certificates from the countries where we were born, even though I only lived in Libya for six months and have not lived in Serbia?

 

Any guidance or similar experiences would be greatly appreciated.

Yes, as that’s where you were born. Not trying to be snarky, but a country where you were not born can’t validate the records from the country where you were born as it isn’t in possession of them.

Just reconfirming, birth certificates must come from the country of birth.  In the USA, each State, issues birth certificates, but they are States of the USA.

Facts are cheap...knowing how to use them is precious...

TkxMr pushback You're referring to states within the USA, but in my case, it's different. I was born in Libya, which is one country, and my nationality is Tunisian, which is another country. So these are two different countries, not states like in the U.S.

The answer is the same either way. You need the birth certificate from where you were born.

My first sentence applies to you.  The second sentence is extra information about the USA. You need a birth certificate from Libya.

Available

Fees: 500 Libyan Dirham = 0.5 LYD

Document Name: “Chahadat AL Milade” in Arabic.

Issuing Authority: The Civil Status Office

Special Seal(s) / Color / Format: Printed on A-4 white sheet paper and has a vertical barcode and a stamp. Rectangular red stamp bearing the following transcription: Department of Civil Status, 500 Dirhem, In exchange of civil status services.

Round blue stamp with the following transcription: Ministry of Interior, Agency of Civil Affairs, Name of the Civil Status Office’s branch.

Issuing Authority Personnel Title: Civil Status Officer on Behalf of the municipality.

Registration Criteria: Registration is not required

Procedure for Obtaining: To obtain a Libyan birth certificate, non-national applicants must send all pertinent information (including name, date and place of birth, and full names of parents) to their respective Embassy in Tripoli. That Embassy will then make a formal request to the Ministry of Foreign Affairs to obtain the certificate from the appropriate municipality. Libyan applicants, or a friend or relative of the applicant, must appear in person at the appropriate municipality office.

One must provide his or her family book.

Certified Copies Available: Certified copies are not available.
