Hi all. My family applied for my sister-- who has children and a husband-- in 2011. My nephew was only 11 at the time and their case was moved to the NVC after four years. Now, my nephew is nearing the age of 25 and is close to aging out of the case. He is on a temporary visa in a foreign country that is more than likely not going to allow him to stay without the rest of his family-- not even taking into factor that he is unable to support himself without his parents. Please, if there is any advice, guidance, or resources anyone can provide, we would be eternally grateful. If you could even provide any success stories or instances where others have been able to get assistance from legal professionals, please comment. Thank you so much.

Has he considered getting a job?

 

F4 btw has many years to go. So most likely will not be an issue.

I’m not really sure what kind of ‘success stories’ you mean? Either he’s going to be eligible for a visa or he’s not, and legal assistance can’t change that. 
 

There’s no getting around it if he ages out out, and if he was 15 when the case was sent to NVC then presumably the I-130 took no more than 4 years for approval? So sounds like he’s aged out already, or certainly will by the time his PD becomes current.
 

I’m sorry but I don’t see any way for him to get a visa via this petition. Why can he not support himself at the age of 25?

By success stories I mean if anyone has ever heard of any way someone has been able to obtain a visa through fighting the case or some other manner, such as humanitarian parole. He’s 25, but is in Turkey on a temporary visa with his family and they won’t provide a work permit for him. The only person able to work is his father. They had a business back in their home country, but it had to be closed down due to war and it’s been well near 5 years.

Unfortunately the work he’s been able to do has produced very little income as Turkey won’t provide him with a work permit to find any official employment. It’s sadly not nearly enough to support him on his own.

Fight what, he either qualifies or he does not.

 

The main routes to move to the US are through Family Sponsorship, Investment or Work, DV Lottery may be worth applying for depending where he is from.

 

Once his parents become LPRs they can sponsor adult children who are not married, if he marries then he will need to wait until they naturalise before they can sponsor him.

Thanks for the suggestions. I’ll look further into it.

As above, it’s a matter of law, there’s no visa available to him. 
 

As Boiler has said his parents can petition him once they’re there, but he’s going to be waiting a long time still. Can he stay in Turkey if his father leaves and he’s a derivative on his visa? Where’s his home country? 
 

Sounds like his parents have a tricky decision to make.
