Good morning/afternoon/evening.

 

Background: Active-Duty Marine with AD Marine Spouse. Located in two different states, can't be placed together. Have an 8-month-old son. I am located in Long Island, NY.

My aunt is in Colombia, she has an active tourist B-2 visa. She has used it to come visit us, but I would like to sponsor her so she can stay with me while I finish out my current contract (2 years left). Is this possible? 

 

She is not with any au pair agency, we could possibly find one, but I REALLY need her to be here sooner rather than later. We also aren't concerned about getting a green card or citizenship, it's solely to help me out since I was denied separation for parenthood and my husband can't be transferred either. Thank you for any advice!

For any visa you’d have to pay her the going rate, so if speed is the key thing it may be quicker to just hire somebody in the US? There’s the H2-B visa, but you’d have to prove you can’t find an American to do the job and it’s a lengthy process, so that won’t work. So it would have to be the J-1 I think, but you’d need an agency and there would be other criteria too i.e. she’d have to be attending classes somewhere too. 

 

Note that she cannot do what you’re proposing on her tourist visa as that is considered working illegally.

For personal reasons, I rather not hire someone I don’t know. I know she can’t do it on the tourist visa, I just figured since she has one, it could help her case in getting a different one, but I am not very educated on visas. 
 

what do you mean she would have to take classes? Like a full time college student?

No, not full-time, but a criteria for the J1 is that the recipient is in an exchange program, and if an au pair they have to be studying each week to meet that, not sure on the number of hours required but you can check that. Do also check the other program requirements too, as I suspect there is other stuff (possibly even an age limit, so your aunt may not quality if so). 

 

Also, one other thing to mention is that often the J1 has a 2 year home residency requirement - meaning they have to spend 2 years in their home country before being able to return to the US. So it’s something to bear in mind, as would mean your aunt couldn’t even visit you in the US for 2 years after her J1 visa ended.

Au Pairs must be:
Proficient in spoken English;
A secondary school graduate or equivalent; and
Between 18-and-26-years-old.
Capable of fully participating in the program as evidenced by the satisfactory completion of a physical.
Personally interviewed, in English, by an organizational representative who shall prepare a report of the interview which shall be provided to the host family; and
Successful in passing a background investigation that includes verification of school, three, non-family related personal and employment references, a criminal background check or its recognized equivalent and a personality profile. Such personality profile will be based upon a psychometric test designed to measure differences in characteristics among applicants against those characteristics considered most important to successfully participate in the au pair program.

 

Seems unlikely to apply here, maybe a H2B?

Ah, thought there might be an age limit. 

 

H2B would require a labour cert so also seems unlikely.
