I know asylum officers conduct interviews.  My questions are (1) Do asylum officers just make sure you have grounds for asylum or do they normally decide on your asylum case?  (2)  If asylum officers normally decide on cases, is it hard to get approved, does any one know the approval rates for asylum officers?  The approval rates for immigration judges are posted online.

 

A co-worker who got political asylum, told me she was denied by an asylum officer, she couldn't even answer simple questions and they assumed she was lying.  The asylum officer called the supervisor over who denied her on the spot.  She got letter from immigration to leave the country because her asylum was denied and her tourist visa is expired.  Then she (appealed?) it with an immigration judge, and the immigration judge granted her asylum.  I don't know, she made it seem like asylum officers deny everyone and it's a formality.  Is it common for an asylum officer to deny asylum then an immigration judge accept it or is her case rare?

No asylum applicant should not have a Lawyer

 

Most applicants do not have a valid case but it gets them an EAD and a SSN, many seem to find a USC to marry

 

If refused by USCIS then they will end up in Court and it will be for an IJ to decide. Usually this takes many years.

 

I was watching Hackings show on You Tube a week or so ago, there was a lady on there, she had a UK regional accent with a bit of something else thrown in, she had come in on the VWP and applied for Aslum a few years ago and her case had gone through the system and been denoed but she had found someone to marry.

 

Anyone can apply for asylum, I alwayswondered if I could have made a case.

Asylum cases are TOUGH.  Every appellant should absolutely have a lawyer.  I've even heard that officers and judges are detecting when lawyers use the same "sob story" for multiple applicants, and turn them down.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

most asylum cases are denied due to bogus asylum cases. read this : https://www.aila.org/library/a-fiefdom-on-long-island-an-investigation-into-the-culture-and-practices-of-the-new-york-asylum-office i happened to be interviewed in the same asylum field office. even when i can answer all the questions flawlessly my case still referred to immigration court (removal proceeding). 

 

at the court she will have to attend master calendar hearing just to set the date of individual hearing. it can be 6 months to - 5 years and often the court reschedule the hearing due to various reason for example : IJ passed away, IJ moved/retired etc etc.

I tend to mainly watch Hacking after the event as his shows rarely time with my availability.

 

Now he is about as pro immigrant as a Lawyer could be, but even he gets frustrated with the people who call in who clearly have fake claims, I am sure there are a lot less scrupulous Lawyers who will talk a client into the correct sort of application. They seemed to have dropped them recently but there have been plenty of examples on CNN/CBS/BBC etc where they have covered the caravans heading north and the people they have spoken to have not had legal advice, most do not seem to understand what asylum is supposed to be, seem to think it is just a term to be used that will get you in.

 

I can see why it was introduced 70? years ago, but it has become so corrupted as to be beyond a joke. And of course the few genuine cases get swamped by all the others.
