Hello there! 

 

So.. regarding I-751s (ROC)...

Quick Background/Timeline Thus Far:

  • Granted K1 Visa → Married the U.S. Citizen (2024) → Conditional Green Card Form I-551 Received (Oct 2024) → Filing for I-751 (ROC) 90 days before Oct 2026. I know it’s a bit early, but I want to get everything in order now so there are no surprises down the road.

 

When it comes to submitting evidences for the I-751, I plan to include:

  • Copy of our marriage certificate
  • Copies of driver’s licenses showing the same residential address
  • Copies of official mail we receive at the same address
  • Joint tax returns for the last 2-3 years
  • Joint bank statements (at least one year’s worth - do i need more than that?)
  • Proof of my spouse being an authorized user on one of my credit cards
  • Joint utility bills
  • Joint health insurance confirmation & medical card
  • Photos of us with friends and family

 

My Questions (sorry if too many.. but thank you 😀😞)

  1. How do the above-listed evidences look overall? Is there anything I should add or remove to minimize the chances of receiving an RFE (Request for Evidence)?
  2. I’m not planning to submit a joint lease/mortgage because I bought the house before we got married. The mortgage is only in my name, but we’ve lived together and share financial responsibilities through joint utility bills and a shared bank account. Do you think it’s important to add my spouse to the deed, or is that unnecessary work?
  3. Is a year’s worth of joint financial statements (bank statements, etc.) sufficient? Should I include more than one year?
  4. I don’t have a joint 401(k) or retirement account. Would it be a good idea to add my spouse to one of these accounts and include that as evidence?
  5. I don’t have an auto loan or other loans. Would it be worthwhile to take out a personal joint loan just to add it as evidence?
  6. I don’t have life insurance and I’m not really interested in getting one at the moment. Should this be a concern?
  7. Should I update my will to name my spouse as a beneficiary to strengthen the evidence, or is that not necessary? (I will do it in the future, just costs $$$ right now)
  8. Is it required to submit 2 affidavits? I’ve read that they don’t carry much weight, but should I still have a few people who know us do it for extra support?
  9. We currently don’t have children (we’re in the planning/conception stage). Should I be concerned about this for the evidence?
  10. My spouse (the conditional resident/applicant) is currently unemployed and most likely will be when we apply for ROC. The reason is that I’m working a good job w/ benefits, and we’ve agreed that she stay home and care for the house. Could this have a negative impact on our case?
  11. Should I include I-797 confirmations previously received from USCIS with my application?
  12. My spouse is from a Middle Eastern country and is Muslim, but not from any of the countries listed in the administration's travel ban. We're feeling anxious and just wanted to know if this could cause any issues or affect the approval of our N-400 citizenship application in the future. Any insight would be really appreciated...

4. AFAIK most retirement accounts are not joint. Adding spouse as beneficiary helps for sure. And not just for immigration, in general it's good. What if you pass away etc. At least spouse will have easy access to funds.

7 - It's not something I'd do for immigration, but only if need it generally.

Send documentation SINCE YOU MARRIED.  Send ALL pages of bank statements.

 

In your cover letter, please give the explanation you gave in your original post about how you owned the house prior to the relationship.  It will keep you from getting an RFE about this.

Thank you so much for your advice and support! 

I’ll be sure to make that note about the home.. that one was worrying the most.. 

 

For bank statements - So the thing is that we have been married since July 2024.. and I just recently (last month) put her on my bank account and am trying adjust everything in terms of finances for the ROC.

 

I guess it may seem I’m trying to carefully present the timeline of the finances to avoid complications lol…Do you think I should still put the bank statements prior to having her on the account..? Or just when I put her on (since last month)?

Send the statements since she was added, but also explain WHEN you added her to the account.  Showing that you live at the same address will go a long way - so things with your spouse's name on it from 2024 will be important if you can show that.

 

For example:  Many driver's licenses have the date of acquisition, and the date of expiry on them.  If your spouse's driver's license has that data, it can show where the spouse was living (because of the address printed) at the time the license was granted.
