I tried to dismissed case but was pushed around. I sent email to visa center,they said that they never had my case that I should contact the consulate office. I contacted the consulate office they said that they never had it that they sent it in 2022 to the NVC. Long story short, I got an email stating that the beneficiary got an interview soon. I was shocked! I really want to moved on with my life because I beneficiary just had a child by someone else. I don't want to take it harsh but want to quietly dismissed the case. Please help

More info is needed. What kind of case, and which consulate? What’s the status when you check it online, does it say ‘at NVC’, ‘in transit’ or at the consulate? 

 

When is the beneficiaries interview?

 

If s/he just had a child by someone else then I doubt they’ll still want to move to the US as they wouldn’t be able to take the child or their new partner with them. But it’s definitely worth making sure the application is cancelled just in case.

It's a CR1 visa. I checked online it says refused. He says it's only the child that is between both of them and nothing else. I was suspecting these two people long time ago but he denied it until I heard the news that this particular girl was pregnant for him  The interview is scheduled in the next 60 days.

Did you fill in an I 864 if so have you withdrawn it.

I sent the immigration and NVC letters of dismissal yesterday. Hopefully they'll get it this coming week. I might had forgotten to sign it but did send it yesterday with my name attached to it. I hate that I have to do this but I have to, to save me from pain in the future.

Hopefully, you specifically ask NVC you want to withdraw the I864? Once you accomplish that, you'll write USCIS to withdraw the I-130.

The applicant had the interview years ago but was denied. We fought the case and was given another opportunity. While waiting, the applicant had an affair with someone and they both had a child sometime last year. It hurts to move on but I don't want a repeat of what I experienced years ago. The earlier the better. I don't want no argument or back and forth, I just want to quietly proceed without creating a scene.

If you have sent letters to USCIS, NVC, and the consulate before the visa was issued, you have done more than necessary to withdraw a case.  I think you can peacefully move on and seek happiness for yourself.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That is all you can do.  You have fulfilled your obligations to withdraw the case.  A visa cannot be issued without a valid I-130 and a valid I-864.
