My husband is in the process of filling out his N-400. We are wondering about the question about selective service. Do those who come to the USA on K-1 visa's have to apply when they enter or when they receive their green card? 

He came to the USA on a K-1 visa in 2017 at which point he was 25 years old. He got his conditional green card in 2019 at which point he was 26 years old so we assumed he did not have to apply at that point because he was over the required age. However recently we have gotten some conflicting information that he should have applied right when he entered on his K-1 visa.

 

Also he is now 32 years old which the instructions for the N-400 state he isn't required to provide evidence for not registering for Selective Service because it is past the 5 year point for good moral character. However the other question would be 22a. and how to answer that question. It asks if you are a male living in the USA but specifies that lawful non-immigrants should select no. Would he be a lawful non-immigrant at this point as a K-1 is a non-immigrant visa (and thus should select no)?

How old was he 90 days after he entered

 

He has done the 5 years anyway

I stand to be corrected but I think that is when he needed to sign up.
