Several years ago my wife came to the US via K1 visa. She currently has a green card that is almost 3 years old.

 

She recently made an international trip to visit her family, and we're now worried that she might be denied re-entry at the US air port.

 

There is a lot of political news floating around saying that visa and even green card holders may:
- be denied entry
- have to give up their phone passwords so that an officer can inspect their texts, photos, and social media

- taken into interrogation room for hours

 

Should we be worried?

Technically, yes, CBP can search LPR and US citizen's phones and take them into interrogation room too.

 

Should not be worried, unless had overstay in the past, criminal history or association with questionable organizations. LPRs who spend too much time outside the US may be pressured into surrendering their GC (I-407)

How long has she been outside the US?  Please be aware that the media blows most everything out of proportion.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Should you be worried about the possibility? Yes

Should you be worried about the probability? No

 

Detaining a few suspicious cases out of the millions of daily travelers is probably lower risks than getting into a car wreck, but are we more worried about car wrecks?

Did she remove conditions, is it her unexpired green card? 

 

Otherwise, might be harder to board her flight.

Nobody but citizens are guaranteed entry into the US. It has always been like that, nothing has changed.

There was the case of the Hamas guy but I am assuming that sort of situation does not apply here.

 

When I cam over there was the case of the USC who had naturalised 50 years prior, he was a Concentration Camp Guard, stripped of his Citizenship and deported.

 

So never say never.
