thats the plan.. but the question is, do I need to file a 131 and 765 again?  i was told not too.. but not sure.

Your denial notice states that any I-765 and I-131 which were filed as a part of the denied I-485 are also automatically terminated.  You need to refile them, too.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

CrazyCat..  but there is a (  statement on the document that states we have 18 days to refile the I-485); if not the I-765, and I-131 will be terminated.

The document indicates that those 2 (765-131 ) will remain active while the new 485 is pending.. if I go past 18 days they will then revoke the 765 and 131.

It also says "proof that your Form I-485 remains pending".  The I-485, which was the basis for the EAD and AP, are terminated......no longer pending.  A new I-485 will require a new I-765 and new I-131, imho.

that's why my wife and i are working on the 485 as I speak to you now.. once I get the i-485 in, then I reach out to USCIS and inform them that a new i-485 is pending.. because the 131-and 765

have not reach it's expiring date

There is no mention of 18 days for AP, only the EAD. You must read anything from an official source really carefully, not just skim it!

But I would concur with @Crazy Cat I think, and think that the 18 days would only be applicable if you were filing the I-290B so the underlying I-485 would be re-opened. But you can always file and then try it, and if you’re now hiring a lawyer (as advised above) to help you with the new application, they’ll be able to tell you for sure.

Good luck.

First, the note on the denial does not include the 18 day (new one to me) disclaimer for the I131, so in my reading the I131 is gone.  I have not seen this note before, it is not clear is if this note refers to a new I485, or an I290B filing for the original I485 (my guess is the I290B). Regardless, my take is you need a new I131 and I765 with a new I485 filing, and I also see this with many lawyer opinions.

Good Luck!

If your I-485 is denied then any other application filed based on that I-485 is no longer valid so you would have to file all 3 if you want the AP and EAD

I-864 would be a supporting document for the I-485 only.
