I-130 on hold?

Timeline

I am wondering, since we received NOA for I-130 nearly two months ago, and since the I-129F has not been sent in yet (by our lawyer...), is the I-130 being put on hold while waiting for the I-129F? Or is it still being worked on... I only got 1 touch 2 days after the NOA and since 2 months, nothing at all... Thanks all for your always so great help.

Our I-130 was approved in 291 days from our filing date.

I-129F:

08/22/07 I-129F sent to CSC

09/04/07 NOA 1

03/10/08 NOA 2

Our I-129F was approved in 201 days from our filing date.

Children's I-130:

01/26/08 I-130 sent to CSC

02/20/08 NOA 1

09/10/08 NOA 2 for two of the children.

09/12/08 NOA 2 for the third child.

03/31/08 Arrival in the U.S.

AOS:

I-485, G-325A, I-765, I-131.

05/29/08 AOS sent for Christine and the children.

06/10/2008 NOA 1

07/01/2008 Biometrics

07/18, 23 and 25/08 Physicals

08/30/08 Employment Authorisation (valid for 1 year)

08/30/08 Authorisation for Parole

11/19/08 SSN (valid for work only)

12/04/08 Initial Interview appointment / Rescheduling requested

02/03/09 Interview appointment / very easy, very nice officer, not too many questions, our evidences were enough

02/03/09 Green Card granted for the four of us

02/16/09 Green Cards arrived in the mail

Timeline

I had no touches to I-130 for almost four months until it was approved. I do not believe the touches really tell you anything. They are supposed to be an indication when the case is accessed, but I have found that is not true. I don't think you can predict the processing rate anyways. One thing is more certain is that NVC processing of K3 is within a few days whereas for 130 is within two to three months. This is ofcourse after USCIS is done with it.

Timeline

My question would be why its taking 2 months to do the i-129f. It only takes a 15 to 30 minutes to fill out the form. Plus if its taking that long, I would suggest filling it out yourself.

If you have not sent out the I-129F yet, as far as USCIS is conserned they are processing the I-130 as a CR-1 or IR-1 visa petition, after NOA2 they will just send it on to NVC.

Now if you were to send in the I-129F after NOA1 but before NOA2 then they may hold the I-130 to allow the K-3 case to continue, and save NVC and the consulate from processing 2 cases only to have the K-3 adjust status.

Personally I would just go with the CR-1 Immigrant visa, it costs less, takes a bit longer, and results in a green-card upun entry allowing work, the adjusting status from K-3 costs $1010, and EAD is needed if you want to work, EAD can take up to 90 days to get.

The K-3 verses CR-1 subject comes up often lately with the massive increase in AOS fee.

We did fill it in ourselves... My husband is in the U.S., i'm in the south pacific and my embassy will be in France, so our lawyer, who is both a France and U.S. lawyer is in France... It's complicated because of geographical issues.

Anyways, I understand the process better now. I know K-3 is much more of a pain fee-wise, especially knowing I'll be moving with my 3 children... imagine the fees then... I will talk to my lawyer about holding on the I-129F untill we get the NOA2 from I-130 then. Again, how long does it "usually" take to get the NOA 2 for I-130? Thanks.
