Hi all,

 

Can anyone tell me what box the main sponsor (USC, spouse of K1 entrant) must tick on pg.1 of I-864 when the AOS application will include an accompanying I-864a from an additional household member?

I am unsure if it would be 1.d. or 1.e. due to the definition of "joint sponsor".

Wow, thank you, so glad I asked! For some reason it didn't even occur to me that it would be that, maybe because I am completing my own I-485 so thought I would be the petitioner?

the I-864 is specifically for someone who is sponsoring the immigrant. since the immigrant usually cant self sponsor.

for AOS from a K1 visa, the person filling out at least one I-864 will almost always be the original petitioner of the I-129f.

 

even if you had a joint sponsor, i.e. someone else filling out the I-864 in addition to your original petitioner, your original petitioner would still check 1.a, from my understanding anyway

Also note that the I864a can only be filed by a CO-sponsoring Household member who is also BOTH:

1. A parent, sibling or child of the original sponsor and

2. Lives with the original sponsor at the same physical residence.

 

Any other person than that is automatically a Joint Sponsor and that means they are standalone, can't combine income with the original sponsor and must meet the $$ guidelines for their own household PLUS any immigrants.
