Hi everyone,

 

I’m in the final stages of obtaining a Green Card through the F2A visa category, and I will be moving to the U.S. soon. My girlfriend and I are not married yet. She has been actively working in the tourism sector for the past 6-7 years, holds an associate degree, and does not speak English.

 

If I apply for her under the F2A category after I arrive in the U.S., the process will take a long time, and we may have to be apart for several years. That’s why I’m looking for an alternative way to bring her to the U.S. as soon as possible.

 

Considering her profile, which visa type would be the most suitable for her? Would a tourist visa (B1/B2), student visa (F1), or a work visa related to the tourism industry be a viable option?

 

Any advice or experiences would be greatly appreciated!

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

She can’t move on the visas you’ve proposed. There is a chance she would get away with it (a slim one, given what the US government can look at when you apply for a visa), but if she lied at any point then she could risk a ban from the US and even future status such as green card or citizenship being taken away. She can absolutely apply for a F1 if she has the funds to pay for studies in the US, but must be honest about her intentions if asked. A B visa is fine for her to visit you, but its only for stays up to 6 months. 

 

If she wants to move then you would be far better off exploring other options - an employment based visa for instance (most of which are ‘dual intent’, so she is allowed to use them if her intention is to stay permanently via you), your parent naturalising and you switching to F3 category so you can take a spouse, or you getting you green card then getting a re-entry permit so you can return to your home country to be with her for some of the wait. 

 

Which country are you both from? And what stage are you at, have you had an interview? Or submitting docs to NVC

Everyone that matters 

your F2a is in the system and is seen by embassy and CBP 

 

embassy should deny anything else you petition for 

if they gave her B2 to come as tourist , CBP can turn her away when they check in their computers 

 

she could have petition for dv lottery (if country is available ) but it is closed now till October and the odds of getting chosen are not in her favor

Do you want to risk this considering the current climate regarding illegal immigration (because that's exactly what you are proposing)? Would you feel the same way if your girlfriend is denied entry and put on a plane home (if she's lucky) or be detained indefinitely (reports of this scenario have become more common)?

 

Also, CBP can look at your phone/texts/emails/check any electronics when entering the U.S. If you are being this cavalier about it, I certainly wouldn't trust you to not have something incriminating on your phone about your "plan".

Really?   This is one of the reasons US immigration is so messed up, and people doing things legally have extended delays.   Thanks for that.
