Hi everyone! I have a question I hope you can help us with. My fiancé and I wanna apply for the K1 visa (I'm the beneficiary). I'd like to take my child with me on a K2 visa.

 

I was wondering if when filing the I-129F form I need to show that I got permission to take my child with me, or is that something I gotta provide for the interview?

 

My child's father is being complicated in giving permission (he's been hard to deal with for years), so we went to a judge to get substitute consent from a judge instead. I should expect this somewhere in June or July, but we were wondering if we can file the I-129F form already or if we have to wait for this because they need to see the approval.

You will need permission when you interview, it can be quite unusual for a Court to permit a child to migrate when the other Parent does not agree.

The Netherlands. My lawyer thinks it very likely we will get consent because the father has been living in a different country for the past 5 years, hardly is in touch with my child, hasn't seen him in 2 years and he did consent (he agreed to it in email) but refuses to write the letter to me.

You do not need this at the I-129F stage... As @Boiler stated above, it will come into play at the consulate interview stage.
