Hello everyone,

 

my wife and I are getting ready to send in our I-130 application this coming week but are a little confused about what determines how the government chooses between giving us an IR1 or a CR1. I understand the I is for over 2 years while the C is under. Does the fact that we will probably be married for over two years by the time our visa is approved mean that we will automatically get the IR1 instead of the CR1, or is that something that is decided earlier on in the process? I am sure that this question has been asked before but I appreciate your help. Thank you 😀

The correct immigrant visa will be issued, based on how long you have been married on the date it's issued.  Then, the correct green card will be issued based on how long you've been married when the immigrant enters the USA using the visa.  CR1 and IR1, are both visa categories, and resident statuses.

Facts are cheap...knowing how to use them is precious...

Theatrically R1/CR1 is determined at the date you're admitted into the US as green card holder marriage base.

Less than 2 year.... CR1

2 years or more.... R1

 

NB: According to the current processing time ; If you file I-130 now, you will probably be admitted in 2 years plus... R1

NB: Accthording to the current processing time ; If you file I-130 now, you will probably be admitted in 2 years plus... R1

It is neither "theoretical" or "theatrical".  IR1 and CR1 are both visa categories and resident status categories.  You can be issued a CR1 visa after for example, after 23 months of marriage, and enter the USA after 24 months of marriage and receive IR1 resident status.  Depending on the actual timing, the correct visa will be issued, and the correct status will be granted.  Sometimes there are mistakes, but they can be corrected after the fact.
