Hello,

 

I am the US citizen.  My fiance is from Ukraine.

 

I will be filing the I129f in a little over a month because she decided to go ahead and come now.

 

We have a large age gap, I have been divorced 2 times, I have a DUI to document in 2019.

 

We have had a relationship for a long time and my question is should I document more than the one trip.  I have details for 5 or so trips and want to be able to overcome the red flags already mentioned.  I would think showing that we have been together many times and will 3 or 4 more times this year would help with the red flags.

 

Any advice would be useful.

Brian, good thinking.  What you're describing is called "front-loading the petition package."

 

The requirements to pass USCIS's standards for the petition are minimal.  Petitioners often fail to realize that the visa interview at the consular phase is even more crucial.  When dealing with a difficult consulate or one in a high-fraud country, it's prudent to include extra "evidence of a bona fide relationship" such as documentation of your multiple trips.

 

It's important not only to document your DUI, but to clarify that your fiancee is fully aware of it.

 

I would put USCIS's required materials on top of your package, and behind this have a cover sheet with "FOR THE CONSULATE" atop the boarding passes, receipts, and selected photos from each trip, along with selected correspondence throughout your relationship, that you want the consular officers to see.

 

Be very careful to exclude any correspondence in which you playfully refer to each other as "husband/wife."

"Now" is a relative term -- it will take many months before your petition is adjudicated, and months after that before it's assigned to a consulate, and longer still to obtain a visa interview.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I couldn't agree with @TBoneTX more on "Front Loading" the application.... This is exactly what Jaycel and I did because we knew that the Consular Officer conducting the interview will have access to the I-129F packet to review at the time of the interview (My I-129F submission was 110 pages) and Jaycel could tell from some of things he said during the interview that he was looking at the I-129F packet (commenting on things about me, about some of the places we'd been together, etc. that would not have been in her DS-160 application). We have also just recently met a Fil-Am couple here in Denver who were a couple of years ahead of us in the K-1/AOS process and told us that the USCIS officer conducting their interview for AOS said, "I see from the evidence that was submitted in your I-129F petition that you both were together for quite a while before you decided to start the fiancée visa process."  They said after that, there were just a few basic questions and she was approved for her green card the day after the interview.

Provide certified court copies of the disposition of the case for your DUI to USCIS in the I-129F application (I had to learn the hard way through an RFE that they require this) and the Consular Officer will disclose your history to your fiancée during the interview and ask her if she still wants to continue with the process. (At least they are supposed to).

In addition, the consulate isn't able to refuse the visa on the basis of information that USCIS has seen and passed on.

Thanks for the info.  I thought it would be good information to add and not just dead weight just wanted someone with some experience to weigh in.

 

I had tickets to go and make everything final in first week of March 2022, then everything went into a tailspin.

 

Also, I understand that "now" means a year from now.  NOW meant that she had previously decided that she would not leave her family during the war so we have been waiting to file until she was "comfortable" or at least resigned to it.  Her dad was killed, her sister fled the country and with any luck there may be an end to the current war at least by the time the K1 gets approved.

 

I will be there in April to May.  I go every 3 to 4 months so I have plenty of trips to document that this is not the result of some vacation fling.
