Hello , I applied for Removing condition (I-751) for my Green Card on April 7, 2023 together with my husband. 

We provided the following evidence that the marriage was entered in good faith: 

- A Bank of America joint account statements;

- A 2021 tax return document;

- Photos

 

Then we recieved a letter  (January 28, 2025) "Request for evidence " where they declined our tax return like evidence, because it was without indication that our taxes were filled with the appropriate agencies.

 

My question about this issue.  I attach the printscrin from the letter. 

I want to know how to  make a stamp or transcript and if i make transcript is it going to be the same like a stamp and will it indicate that my taxes were filled with appropriate agency.

And  the second question about those agencies. How can i know that agenci is appropriate?

You need to create a login with IRS.gov and download the tax return transcripts.

Go to irs.gov and create an account. Once the account is created you can download the tax return transcript from that website

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

They key to success is to provide what they asked for (see messages from @EatBulaga and @Edward and Jaycel)

 

Plus add updated evidence. You need a lot more: new bank statements, lease agreement or mortgage statements showing you live together, utility bills in both names, affidavits, copies of trip reservations taken together, copies of car or health insurance showing each other.

 

Without this, USCIS can issue NOID or deny case.

It is indeed a problem. That's probably why USCIS cannot approve the case, as they don't see enough evidence of bonafide marriage.

 

I agree with @Boiler in asking why coming up with evidence is difficult in a legitimate marriage?

We live in the friends house, so we pay to them.

Then, my husband had his own insurance, since I came

So, we didn't buy a car, because we don't need it, he is working from home, I always have a ride.

And, yes, our live style is probably weird for others, but it's how we live and we didn't expect it's going to be that important to have bills for both names. Everyone lives different 

 

I just want to know if it any chances to do something in that case? Maybe to ask them about interview somehow?

Interview is the last thing you want, because I foresee it being a stokes interview. You'd be separated and grilled for some time with different questions about you, your spouse, marriage and other things. If some answers won't match, officer may accuse you of fraud. Or scare US citizen spouse into withdrawing their support of your I-751.

 

The living arrangement, again, may raise some brows at USCIS.

 

Do you at least have matching state IDs / DLs with same address?

Do you have Costco / Sam's Club membership listing both names?

Amazon household account?

Shared phone plan?

Letters from friends and family to both of you showing current address?

 

 

You really need to think hard how to prove the marriage. The worst case, you may eventually lose GC if you can't provide enough proof of bonafide marriage

Haven't you filed taxes since 2021?  If so, you will have more tax transcripts to send.

 

Even with separate bank/financial accounts, you can still list each other as beneficiaries.  If you have separate insurance policies, you would have some correspondence sent to the same address. 

 

"Everyone lives different", yes, I agree.  However, it is a little bit the responsibility of the immigrant (and their spouse) to see what might be required of them in the future to keep their residency.   Husband and I still do not have a joint "bill" after 16 years.  We still have plenty of other stuff to show that we live together and commingle, in our own way, our finances. 

 

See about:

Wills/Living wills

Any official communication sent to your common residence

Setting up each other as beneficiaries on financial/bank accounts.  

State ID (if you do not have a DL) to show common address.  

Formal (or informal) lease from your friend.

If you mean affidavit from friends, the letter template I gave to our church members to fill out and sign (notarized preferably) is below. The completed affidavit letters were maybe 4 sentences top. We scanned it and were instructed to upload to myUSCIS along with submitting a copy with the I-693 medical package. Go by what USCIS instructions for you.

@Maria Babeshkina forgot to add that that the affidavit signer needs to provide their contact info in the letter in case USCIS needs to follow up with them. So you end up owing some lunches to friends or family.
