I have a question regarding the surname of my fiance.  On my USCIS petition, I put her mothers surname and fathers surname (Ortiz Hernandez).  However the K1-FTP does not list her mother's name anywhere.

 

We filled out the DS-160 and used her mother's name and her passport has her mother's name.  We started the visa application and used her mother's name as well.

 

1) Is this something I should be concerned about?  I know dual last names are common in the Philippines.

 

2) Is the visa appointment letter required to perform the medical exam at St Lukes?

Generally in the Philippines, if the parents were married, the child will have their mother's surname as a "middle name", which is rather different than the US concept of middle names. On her Philippine passport is the mothers surname listed under the field, "middle name"?  (a field which does not even exist on US passports)  Middle names are generally treated rather loosely in the US and ether get lumped in as given names or even omitted without much consequences.  Probably everything is fine but it might need explained at biometrics or at the pre interview document check if you used any nonstandard Philippine usage anywhere.  Her Philippine passport usage would take precedence.

Her First Name and Middle name as they appear on her passport should go in the "Given Names" section of the DS-160 and her Last Name as it appears on the passport should go in the "Family Name" section of the DS-160. This is how Jaycel filled hers out and was concerned and she asked about it when she went to the embassy for her interview and they told her that was the proper way to fill it out.

if you don't have the appointment letter, bring just the K1-FTP letter. SLEC may or may not make her sign a waiver saying they are not responsible for delays in the interview scheduling process that may require her to get another medical exam if she can't get an interview before her medical exam expires. Regardless, she will be allowed to take the medical exam.

Philippines doesn't have dual last names. However, it's the law to follow naming convention (Philippines Republic Act 386)

 

Middle name = Mother's Maiden name or None (if illegitimate child)

Last name = Father's last Name or Mother's last name (if illegitimate child)

 

It may not be very strict in US side of things. Since in US, middle name is just part of the given name.

 

But, It's pretty strict on Philippines side in terms of names since it's the law. If her DS-160 is incorrectly filled out and doesn't match her passport, make sure to have it corrected. If there are corrections in any of her documents, inconsistencies in her names, make sure to have it all listed in her NBI clearance’s AKA field.

Ok. Thanks for the advice.  I think the DS160 has the dual last name (I filled out the DS160 so stupid me)

 

She already completed her medical but her interview is not until mid May. 
 

I will make sure to update the DS160.  Is it easy to update?

I went into the system and I see it will force me to re apply if within 30 days.  It looks like we will have to reschedule the appointment and pay the fee again.  The money is not a problem but the reschedule and perhaps medical will be a problem.

 

On the confirmation page it says:  Ortiz Rodriguez, Mary.     Ortiz is her mother's name and Rodriguez is her last name, Mary is her first name.  Ortiz is shown on her passport as her middle name.

 

Will she have to re-do the medical again because there will be a new DS-160?

No need to pay, you just have to create a new DS160 and that will invalidate the current one.

 

First name: Mary

Thanks for the advice.  But how exactly will creating a new application not trigger a new fee and scheduling?  I am new to this so forgive my ignorance.

You're absolutely fine. :)

 

Create the new DS160 just how you did it the first time. Then since you guys have an interview already, you must submit a Feedback on the website or call them to have DS160 update barcode updated on your application.

 

Do not Close and Start a new application cos you will lose your booked appointments.

Ok.  So when we create the new DS160 we do NOT submit it?  After we fill out a new DS160, we then send feedback to the USEM and tell them what?

Submit the new DS160, it will give you a new barcode/letters. Thats the new info you will provide to customer service or on the feedback form.

We had our DS-260 form "re-opened" (I think it is locked after they review and approve it) so that we could change my wife's listed name from her maiden name, which we originally applied using, to her new married name.

(This is not strictly needed--the embassy officer can do it at the interview--but the embassy advised us they could open the file for editing and we could go ahead and fix it so we did.  Interview passed successfully by the way)

 

There was no "new" barcode generated.  All our info was the same, including our case #s, etc.  They just updated an old DS-260 form with a new one.

 

My advice would be to call the new embassy office which recently opened at (+632) 7792-8988 or (+632) 8548-8223 or (703) 520-2235 (1=english,option 3, 3, 5) - [the phone contact as of March 2025]

and ask them what to do.  In my experience, they answer promptly, and would give you the most timely advice.

K1 uses DS160 which CANNOT be edited once submitted. A disclosure will pop-up prior to Sign and Submit.

 

Unsubmitted or Saved DS160 will be deleted after 30 consecutive days of inactivity.
