Hi and apologizes for starting another topic so soon after the one I just posted, I just felt this would be much easier to separate the two.

 

So, I'm a disabled veteran receiving compensation and SSDI. I haven't been required to file a tax returns since about 2009, since according to the IRS I make no income.

 

Going through the information about the I-864, I am definitely 125% above the Federal poverty line, even with two beneficiarys.

 

Will not having tax returns hurt us? I also read there are certain tax codes/rules I can attach to this, which shows I am essentially excempt from filing taxes, which for all intents and purposes I make $0 income.

 

I do have investments, which i haven't touched in years from family who passed away and i got into Bitcoin early, but I don't touch any of it. It was always a "set and forget" till retirement, which unfortunately came at a young age during the wars.

 

Anyway, if anyone could possibly maybe ease my anxiety on this, I would appreciate it.

If I was in your situation this is what I would do....

 

If you take a look at uscis's website for the Affidavit of Support it lists,

 

"You are required to provide your U.S. federal income tax return for the most recent tax year as well as proof of current employment. If you were not required to file a tax return in any of these years you must provide an explanation. Failure to provide the tax return or evidence establishing that you were not required to file will delay action on your relative's application for permanent residence. If this information is not provided, this will result in denial of an immigrant visa or adjustment of status."

 

I would include a explanation letter and attach verification letters of your benefits from SSDI & the VA. you can go to the VA's website and download your Benefit Verification Letters directly. I'm not sure about the SSA. and any other proof or assets to establish you meet the 125% requirement and not required to file a Tax return based on if you meet the age/income threshold

Awesome. So, per the benefit/reward letters from the VA and SSA, i can change the address at a moments notice. Would it be recommended, to change those addresses, to my domicle in the US? The reason I ask this, is because I'm technically not outside the US temporarily, but that could be argued due to the whole covid pandemic.
