I filed the 129f for my fiancé In September of 2024. Today I got an RFE in the mail requesting proof that my previous marriage has end. My last marriage ended in death, unfortunately, and I already sent in the death certificate with my petition.

Does anyone know why they are requesting this even though I sent that in already. Any suggestions on how to reply, should I just reply and send in another death certificate?

Death occurred in US, and I sent one of the copies that I received from the state after she was buried.

Did you request those copies yourself?

Are they certified copies?

It may sound strange, but this happens with marriages (not sure about deaths). On day of marriage I received "document" named marriage certificate. But it's not a real thing. I had to request and pay fees to get certified copy, which is a legal document accepted by USCIS.

Or as @Edward and Jaycel said, maybe they lost it.

They were sent to the funeral home and then given to me, but I will go to the register of deeds office in the morning and verify it’s a certified copy before mailing it off.

If it has a stamped seal you are fine.  Typically funeral homes provide certified copies of the DCs to the family after the funeral.  I think this is more like what @Edward and Jaycel suggested, just send another certified copy in response to the somewhat pointless RFE to get the case back on track.

Good Luck!

I contacted the deeds office and my copies are definitely certified copies, I typed up the cover letter, added the original RFE letter on top with the certificate. Fingers crossed we will get approved once received.
