I submitted the I-129F for my fiancé, we received NOA1 on 12/19/2024 so I'm assuming it will be some time before we get NOA2 and even longer to schedule an interview so I'm hoping I have ample time to get my questions answered and the I-134 to my fiancé in time.

My circumstances are not very straight forward. I am currently unemployed but looking for a job, even minimum wage in my state exceeds the poverty guidelines so I'm not super worried about my income. Here are my circumstances.

1. I am on tax payment installment plans for both the IRS and NYS and have not been delinquent on payments.
2. I own 4 properties including my primary residence

3. Own an IIRA that I've been taking distributions from

 

I have an interview tomorrow (3/11/2025) for a job and have submitted dozens of other applications, my question is this.

When I mail the I-134 to my fiancée, what evidence do I need to submit to show proof of value and ownership of my assets?

Should I try to find someone else willing to cosponsor?

Do I need to include information about my payment installment agreements with the IRS and NYS?

Should I contact an attorney for professional advice?

Doesn't hurt to have any income statements as long as your income is 1.25 * poverty guidelines for the number in your household + K1 beneficiary.

 

1. Do you mean the estimated tax vouchers? If yes, then that's not a problem. Just show your past 3 year's tax return transcripts showing you paid your taxes. 

 

2. Can show appraisal values of properties and/or deeds. Are properties collecting rent payments? If yes, then that should show up in the tax return transcripts. And you can show rent deposits and explain in the last part of Addition Information.

 

3. Do you have 1099-R? Distributions should show up in the tax return transcripts. And show the bank deposits of the distributions.

 

Is your income 1.25 * poverty guidelines for the number in your household + K1 beneficiary? If yes, then you don't need a joint sponsor. You can also include a bank reference letter showing your gross deposits and withdrawals from the past year.

 

I-134 is not legally binding. I-864 is legally binding.

With the I-134 (and subsequently the I-864 for the AOS), current income is king. If you get a job before the time the form is needed, this is proven with pay stubs and an employment verification letter (if your employer will provide one). If that current income is more than the poverty level guidelines for the form, then assets are not required to be disclosed.

The I-134 does not require you to provide any info regarding your tax situation except this part from the "Supporting Evidence" section of the instructions:

Copy of last U.S. federal income tax return filed (tax transcript). If you did not file a Federal tax return, or if your Federal tax return does not properly reflect your current income, submit copies of consecutive pay statements (stubs) for a minimum of the past month, recent Form W-2, or Form SSA-1099.
