Hi Members,

 

Have some specific question for my n-400 online filling. I am filling based on 3 year rule of married to US citizen.

 

  1. I provided a different email than what my uscis account was created, in your contact information section, should that be fine?
  2. How many children do you have? This would only accept numeric values. Instructions say type or print “None” unless otherwise directed. Do I need to put 0 and explain in a letter of explanation what I can upload in "Additional Information" section
  3. How many times have you been married? We had church marriage too and have a certificate from our church weeding. Is it safe to put 2 and do I need to attach any additional documents for this.
  4. On what date did your current spouse become a U.S. citizen? Does the issuance date go here? My husband got citizenship due to naturalization (born outside US). The certificate he has contains 2 dates one in 1996 and the other one in 1997 (this has issuance date before it). I'm understanding I have to use the date from 1997 for this question.
  5. I want to upload I-797 for pending I-751, does this go in "Additional Evidence" or "Additional Information" section. 
  6. Anyone has format for the request for combo interview when I-751 is pending. Is it a good idea to attach one, does this go in "Additional Evidence" or "Additional Information" section.

 

I am attaching:

- Marriage certificate, bank statements, tax return transcripts, account transcripts, health insurance proof, mortgage statements. Anything else missing, any suggestions are appreciated.

3. The question asks how many time you were legally married. Unless you divorces and remarried, you've been married 1 regardless of how many ceremonies you had celebrating your marriage.

6. Additional evidence. Just write a short letter saying you have pending I-751 (case number) and you'd like go adjudicate I-751 and N-400 together.

Based on what you described, even with a church certificate, I would just put 1 for the number of times married.  Unless you ended (officially) a marriage, and then remarried to the same person, would I say 2.

One date is for WHEN he became a citizen, the other date is only when the PROOF of his citizenship was issued. So obviously you go with the date he BECAME a citizen, not the date the certificate was printed.

If you have been LEGALLY married more than once, you need to upload the divorce decree for each marriage that ended. You cannot LEGALLY marry a second time without divorcing first.

USCIS released 10 updated forms today, among them the N-400 with a version backdated to 01/20/2025 and valid until 02/28/2027.

I wonder if USCIS repeats the dirty trick of refusing applications filed after 01/20/2025 with the former form? Any thoughts?

I know they have done it with I-130 forms.

Nishris clearly stated they had two separate marriage ceremonies, one was a religious one. There is no need of a divorce decree in this case.

USCIS will ask for it if @Nishris says married 2 times.

I'd recommend using the latest form. USCIS is known of wrongfully denying cases on such technicalities

Regarding the 2 marriages, they cannot come up with a divorce decree, they just need to explain both ceremonies belong to the same couple.

I agree 100% with you about using the latest form, my information is to give a piece of mind to those who filed between January 20 2025 and today.

Sigh... two ceremonies doesn't mean a person is legally married twice.

 

I had a marriage at city hall with 4 people which was legal marriage and religous ceremony months after with many guests and family. I got married once.

 

USCIS is going to be super confused and will inquire about divorces if one says they were married twice with no divorce in between.
