I work in a business that has slow times and busy times. The last couple years it's been slow so I've only earned about 35K a year. My mortgage payment is a little high in relation to my income. Even though my income is sufficient, is there any chance of being denied because my mortgage payment is too high? I also have a long term roommate that pays me rent but that is not recorded on my W2 forms. Has anyone had experience with this?

You don't need to report mortgage payments. SO NO they wont deny this.

The consulates treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.
  • Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS
  • Photo copy of IRS form 1040, and W2s for past 3 years
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past 6 months pay stubs up to a few weeks before the interview.

My income was well above 125% povertyline so I did not include any asset data.

Yager,

Do you see any item on any form asking you to report what your mortgage payment is?

Yeah at the top of page 4 on the form. There is a space that says,

I own real estate valued at________ and then the next line is

With mortgage(s) or other encumbrance(s) thereon amounting to: $_______

Maybe I'm mistaken. This must not be talking about payments but strictly about assets. Jeez I need another cup of coffee.

In that context, the mortgage is the total amount still owed. They want to know the equity. You don't even need to complete the asset portion as your income qualifies on it's own

You only list real estate if your income is below 125% povertyline and will be liquidating the real estate in order to make up the difference between your LOW income and 125% povertyline.

SINCE YOUR INCOME IS WELL ABOVE, YOU DO NOT NEED TO USE YOUR REAL ESTATE AS AN ASSET.
