I 130 Mistake

Hello everyone 👋 

 

I filed I-130 for my mom in January 6, 2024. It’s still pending and no movement yet except for when we received Receipt Notice in January 10,2024.

 

My question is I think I messed up when I completed the I 130 form initially 😢 

 

As I was reviewing the form today, I realized I answered no to the question “Has anyone else ever filed a petition for the beneficiary?” I answered no. 
 

My mom, back in 2014?, applied for Tourist Visa and was denied. 
 

When I was filling out this form, I must have not fully understood the question. Thinking back, I thought this means has anyone applied for her before, so I answered no. No one else has, except for when she applied, on her own, for tourist visa, and then now, for me applying for her.
 

Are we screwed ? Is she going to get denied? 😭 how can I correct this? I feel so stupid

A tourist visa application does not require a petition to USCIS so you answered correctly. That question is asking if anyone else has filed an I-130, I-140, I-129, etc., before on your mom's behalf. Don't sweat it, you didn't screw anything up

Just be sure when you get to the NVC stage and fill out the DS-260 for her Immigrant Visa, you DO disclose the denied tourist visa in the appropriate place in the DS-260 form

@Gapsie I sent the message above as you were sending your reply to my first message and want to make sure you saw it. It's very important that the tourist visa refusal gets disclosed on the DS-260 when it comes time for that
