Hi,

 

I'm posting for my brother. He filed a K-1 visa with his fiance in 2022. In October, 2024, she told him they were denied during the interview. My brother did some digging and found out she cheated and was pregnant with someone's child. They broke up. He was dumb and didn't care to notify or check their status since he assumed it was denied. Today, he got word that she actually entered the US on their K-1 visa. Is there anything that can be done as he does not want to be liable for her since they broke up and she deceived him to enter the US? She's also 4mo pregnant with the second baby.

Your post is confusing. How did the applicant enter the US if they were denied at the embassy?

When did she enter the US?  She can't stay legally after 90 days.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Has the beneficiary filed for Adjustment of Status? That's the only way she could be here legally. It can only be filed with the petitioner. She can't adjust any other way. The petitioner definitely needs to notify uscis

Well if he is the Father he may well hear from her, or her lawyer.

 

She may not be interested in status or has plans to find a USC to marry.

If 90 days later she's still in the US, call ICE on her.

He has no obligations, well beyond having nothing to do with her.

Impossible.  Her visa has already been used.
