Hi, my adult daughter, 21 yrs old (K2) left home a year ago and cut off contact due to a disagreement we had. Her ROC is still pending. I recently had my N-400 interview (ROC pending), and the USCIS officer asked me about my daughter. I stated that she moved out a year ago and hasn't had any contact since. I clarified that even though she stopped contact, I am still continuing her ROC as my dependent. I passed the N-400 test but I still don't have status change because of pending ROC. 

 

Has anyone experienced having their K2 move out while pending ROC? Will this affect the process?

N-400 cannot be approved without I-751 being approved first.

 

I won't be surprised if I-751 is stuck now. You have somebody else (K-2) who you do not have a contact with... This is not a typical situation with K-2. Your I-751 case might have been approved if you modified it uncheking the box saying daughter is applying for ROC with you. But I guess it's a difficult personal decision to make.

Thanks. Yeah I guess it is stuck now. The officer asked me if my daughter still lives with me. I didn't wanna lie so I told the truth that she moved out and I have no contact with her for a while now. Is it a requirement for an adult K2 to still live with K1?
