President Donald Trump announced a new visa program for investors coming to the United States on Tuesday that would cost applicants $5 million.

Trump, touting the project as a "Gold Card" program mimicking the Green Cards permanent residents get, told reporters in the Oval Office that it would be up and running in two weeks.

That is really an interesting take.  I must admit when I first joined VJ, I had fairly strong feelings about AOS from B2/ESTA et. al., but those have changed over time.  I know, it allows people to jump the line, and more than likely 80% or more of the couples or people (other IRs) doing it probably decided to do it before entering the US, but there are times when it is really necessary.  My thought is that Congress needs to change the law to allow an AOS interview to also include another entry interview and the beneficiary (and petitioner) has to prove there was no pre-planning to this.

Unsure how one would prove a negative.  It seems to me that the elephant always present in the room is the "change of mind at baggage claim" and no way to get around that.  Do you have a solution in mind?

Sort of like the DoS by law assumes anyone applying for a NIV has immigration intent, let the IO assume anyone AOSing from a B2 et. al., have preconceived a plan to do this when entering the U.S. during an AOS interview.  The beneficiary, then has the burden of proof to show there was no pre-planning.  So sort of like a second entry inspection if the decision is made to AOS on a NIV.

Thanks.  But again, how is pre-planning disproved, and what happens if the petitioner & beneficiary are later found to have lied?  Even if an AOS interview is mandatory for people who wish to adjust from a NIV, I'm not seeing how the holes can be plugged.

How does a B2 applicant prove they do not have immigration intent?  I know, impossible to prove a negative, but maybe through chats, social media etc.  I don’t really know for certain, but I don’t want to penalize someone that had a real major change of circumstances.

One of the saddest happened when I was very new on VJ.  Charles will remember this event.

The message from the widower is on page 13 of the thread.  Throughout the thread are notes from people who in some cases haven't been on VJ for nearly 17 years.

I could see this being handled much like an expedite request.  Generally NO AOS from a tourist visa except for very special cases.

 

"I arrived for a visit and he popped the question and we got married.  Now we just can't bare to be apart"  just isn't going to cut it.
