Hi all, my husband (UK citizen) and I (US citizen) have been compiling all the required forms to submit to USCIC, for his green card and aos, so far I have been following this:

Which has helped me a lot, we will be filing concurrently (i-130 & i-485) I have a couple of questions as I see a lot of conflicting information online:

 

  • is it correct that form I-485 no longer includes the cost of the I-131 and I-765
  • he doesn't need advanced parole i-131, however, he will need I-765; the cost online is now $520 and can be reduced to $260 if I file I-485, with a fee on or after April 1, 2024, and Form I-485 is still pending.  (what does this mean?)
  • Is it better to file i-130 and i-485 together, and then submit the i-765 at a later date so that I can make use of the reduced fee? Or will the reduced fee apply if I submit it with the i-485 when I file it all together? 
  • Final question, when submitting the whole packet, would 1 original Birth certificate for my husband suffice for both forms? or is it a must to include 1 per packet (i-130 and i-485) as at the moment I only have 1 copy 😕

 

I ask as I just want to make sure I am putting the correct amount on the cheque when submitting everything as I would rather not do anything to delay the process.

Moved to Adjustment  of status from a student, work or tourist visa as this reflects the OP’s process. 
 

What visa did he use to enter the US? Just wanting to make sure i have moved it to the correct subforum.

He came in on an ESTA visa.

No not at all, it was a routine visit to the US, we come every year with our kids to spend Eid with our family. And we decided to adjust his status and stay.

1.  Correct

2.  The I-765 fee is $260 if filed with an I-485.

3.  I would submit together.

4.  Each form is a separate entity.  Full packets of support documents for each form.  Do not send an original of ANYTHING.  Send photocopies.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Make sure you have the i-485  i130 the i 864, i693 and if desired i765 and 131. Use separate checks.

I filed i485 and i765. I’m a uk citizen and mrs is us so in a similar situation. Just wanted to remind you to submit the i693/medical as well as I forgot to do that (it’s now mandatory). And for the filing fees for i765 would be $260 if you’re filing the AOS too. Hope you folks get sorted soon.

Yeh thanks a lot for the advice and clarifications. We had to do the i693 stuff here as I hadn’t anticipated staying and applying for his green card. He just had his medical early this week and titer test to check for vaccines.

 

hopefully all goes smoothly.
