:( I just recently marry my husband a month ago. I am about to file for him, but I do not know the forms that i need to file. I am also scared that they might send home to wait for his papers. His visa expired since 2000. We were thanking of hiring a lawyer, but it would cost us $5,000 that we don't have. We've decided to do it on our own. Somebody, anybody please help us. I also would like to know if the I-751 a good form to file to petition for him to stay in the U.S, while waiting for his papers.

Sincerely,

R.B

Hi and welcome to VJ :)

Firstly, did your husband enter legally, was he inspected at POE on entry? If he entered illegally then he is not permitted to adjust status even if married to a USC.

If a person came into the U.S. illegally, that person is barred from adjusting their status to LPR (cannot obtain a green card) even if he or she marries a U.S. citizen or otherwise becomes an immediate relative. An immediate relative must meet the eligibility requirement of being “inspected and admitted or paroled into the United States.”

If he entered legally then papers can be filed. Have a read HERE
