Hi. I’ve encountered a few questions while filling out Form I-485 and would really appreciate your insight. When I was living in my home country, my mother filed an I-130 petition for me, and it was approved (back in 2012). We also filed l DS-260, and I-864 forms to the visa center in 2022, but no interview.  Then, in 2023, I moved to the US through the humanitarian parole program and currently in the process of adjusting my status. Since I was never called for an interview, I’m unsure how to answer the question below, and I don’t have a decision or date of decision as requested in the next question. Any suggestions?

 

Question: “Have you ever applied for an immigrant visa to obtain permanent resident status at a U.S. Embassy or U.S. Consulate abroad?”

If you have ever submitted a DS-260, the answer is "yes".

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you so much for your quick response! Yes, I did submit both the DS-260 and I-864 to the visa center, so I believe the correct answer to the question is "yes."

 

However, I’m unsure how to respond to the follow-up questions asking for the decision and the date of the decision, since I never received a decision or had an interview. Could you advise me on how to address these fields?

 

Also, regarding my son, I understand that he is considered a derivative applicant (he’s under 16). While I didn’t submit a separate DS-230 for him, I did include his name as my child in the DS-260 application. Since he is also in the process of adjusting his status now and is filling out his own I-485 application , does he need to answer "yes" to the same question as well?

"N/A" is acceptable.

Does my son need to answer "yes" to the same question as well? or he can answer "no" since he's just a derivative applicant (my mother didn't fill a separate I-130 petition for him)
