AOS Application Rejected, Please Help!

I-485, I-131, and I-765 were all sent back with the following rejection notice. Original visa is K1, a copy of I-797 NOA 2 (I-129F Approval Notice) was sent along with the application. Thoughts?

on your I-485

on page 5  part 2 section 3.a which option did you pick?

cause it should have been the 4th one

 

if you picked the first one, which is technically true, it is incorrect for USCIS.

 

someone else got the same rejection and this was the reason

Yes... It's almost certain you selected "Spouse of a US Citizen" instead of "Person admitted to the United States as a fiancé(e) or child of a fiancé(e) of a U.S. citizen (K-1/K-2 Nonimmigrant)." 

 

When you check the first box, they look for either a concurrently filed I-130, I-140, I-360 OR a I-797C (Receipt or Approval Notice) from ONLY one of those forms. Since you did not have one they rejected the application.

 

When you check the "Person admitted to the United States as a fiancé(e) or child of a fiancé(e) of a U.S. citizen (K-1/K-2 Nonimmigrant)." they look for your I-797C Approval notice from the I-129F

For sure... The previous version specifically said I-129F in that section:

"Person admitted to the United States as a fiance(e) or

child ofa fiance(e) ofa U.S. citizen, Form I-129F

(K-1/K-2 Nonimmigrant)"

My goodness! Really? So the form has been changed in order to become more confusing.

 

How about putting in the instructions:  "tick fiancé of US citizen if you filled out I129F." The heading to section three could be: "Basis of Entry into United States."
