I'm very close to sending my AOS package off but would first like to confirm a few things:

 

1. Do I need to send the G-325A for both myself and my spouse? (I am the one immigrating and my spouse is my US citizen sponsor) My immigration lawyer said this form is not needed however I've read online that it is.

 

2. Confirming I can send off the I-131 at the same time that I send off all other forms?

 

3. Exactly how many passport style photos do I need and does my husband need?  I have read so many different things regarding this, lawyer says 4 photos for me and 2 for my husband however I've read that I need 8?

 

4. When I photocopy my passport do I just need to do the biographic page or every single page within my passport even if they're blank? I've read mixed things on this too, apparently I need to copy every single page and include two extra colour copies of the biographics page?

 

5. Is it necessary to include a affidavit from my husbands father to testify that my husband and I are indeed married and have been living together at my husbands fathers house for the past 8 months? Or should I provide this type of 'evidence' only if asked for further proof of our relationship? Should I also get an affidavit from my husbands friend to also testify that we are a couple?

 

6. My husband  needs to include 3 years worth of tax returns as evidence of his income? I've read mixed things on this too, some say one year is fine but my lawyer said 3 years.

 

7. Form I-485 page 2 item 19 what is my travel document number? This isnt my passport number right? Where can I find it? 

 

8. Must I include a cover letter? What should I say? Like a table of contents?

 

9. Could I confirm these are the forms I need to send:

I-130A

I-130

I-131

I-765

I-864

I-485

 

10. Must I include a certified copy of our marriage certificate or would a regular photocopy suffice?

 

11. How exactly do I pay? Must we pay in advance and where to? Can it be an online deposit? and must it all be paid at once?

Regarding form I-131, Part 7 page 4 it asks to explain how I qualify for an Advance Parole Document and what circumstances warrant issuance of advanced parole. What should I do here? I'm simply wanting to visit family overseas while my AOS processes. How do I qualify?

Part 7 doesn't ask how you qualify. Part 8 does but it's not applicable.

I checked AOS papers I did in 2019.

Form I-131 had the same text back then.

I never included any statement.

My lawyer filed the case.

I-131 was approved (along with I-765, producing 2 in 1 card).

I filed my wife's AOS in Jan 2022, i just selected More than one trip and did nothing else, no documents or anything. even on my form I left city town country empty because it asked if you want to rcv it in some other country. You can look up at my timelines to get sense of it and also if you can kindly update your own time line as it is very beneficial for people here. 

 

  • Jan 26, 2021 = NOA 1 for I-129F (K1 Visa application)
  • Sep 8, 2021 = NOA 2 for I-129F (K1 Visa application)
  • Nov 16, 2021 =  K1 visa issued in Islamabad, Pakistan
  • Jan 20, 2022 = POE Dallas, Texas
  • Feb 14, 2022 = AOS (I-451, I-131, I765) Filed
  • Feb 20, 2022 = Receipt notice for all three received
  • March 21, 2022 = Biometrics in Dallas, Texas
  • August 9, 2022 = EAD (I-751 approved)
  • August 13, 2022 = EAD and SSN received (SSN applied with EAD)
  • September 6, 2022 = AP (I-131 approved)
  • September 13, 2022 = AP (I-131 receieved) 
  • March 15, 2023 = I-485 approved (interview waived, New SSN received without DHS wording)
  • March 31, 2023 = GC in hand (Total time from NOA-1 to GC in hand 794 days)

1) depends on your circumstances. The page for this form on uscis.gov lists who the form applies to. Read the instructions of the form to see if it applies to you. 
2)I-131 can be filed concurrently with an AOS application. 
3) depends on the forms you file. Typically it’s two photos per form that requires it. Check the instructions of the forms you are planning to file. 
4) the biographic page + any pages that show stamps or visas pertaining to your application. 
5) not necessary but could help your case. 
6) it’s not required to show the last three years, the last year is required. However you are allowed to file three years if you think it helps your case. This is explicitly mentioned in the instructions. 
7) it depends on your passport. Some have a travel document number, others don’t. check with your non American government. 
8 ) it’s appreciated and yes list the contents. this way the people processing your files know what they’re looking at. 
9) this depends on your circumstances. 
10) I went for a certified copy but uscis instructions point out a regular photocopy is enough. 
11) uscis.gov has explicit instructions on how to pay. 
 

even though you have a lawyer it is smart to become an A grade student in these forms. Study the forms on uscis.gov and their instructions. Follow the instructions literally. Read the instructions on the website (e.g. payment instructions.
 

Things vary a lot depending on your circumstances.  Including the address you need to send your file to. Check uscis.gov for instructions on which address you need to use.
