Hello,

 

My fiancée and I are considering the possibility of creating a joint account in the US so that the beneficiary can move their funds to that account for two reasons:

  -The petitioner does not meet the income requirements, so we would have to use assets (she fortunately has the required amount, but to play it safe).

   -We just got an RFIE which we don't know what is about, but in case they need more proofs of relationship, that could help as well (in case a stack of photos could have not been enough)

 

However, all banks are asking for either a Social Security Number or an Individual Taxpayer Identification Number, which apparently can take months to receive and the extra hustle of paying taxes in the US before even moving there.

 

What do you guys think? Would it be worth to create the account? and what about any recommendations in which it is easier to do this?

you would be better off getting a joint sponsor

 

your fiance can't get a SSN until they have arrived in the US using their K1 visa. and an ITIN (if its even possible, im not sure that it is) could take longer than what the RFIE allows for.

 

you don't know what the RFIE is for?

when did you learn about the RFIE?

 

you should wait until you receive that in the mail. so you know for sure what it is they are asking for...

 

finances don't really come into play for the I-129f/K1 visa until the actual K-1 visa interview. which can be over a year after the original I-129f is submitted.

 

not to be harsh but honestly the petitioner would be better off trying to find a better paying job.

 

which i know is hard right now

There is zero expectation for fiances to have commingled finances, such as joint bank accounts.  Photos as relationship evidence are secondary, and relationship evidence is not even asked for at the petition phase.  Evidence of fulfilling the requirement to have met once in the two years prior is best met with boarding passes/passport stamps, etc.

They sent the RFIE on 02/12 and we cannot ask for them to resend it until 02/26 apparentely. 

 

About getting a new job, that is difficult as the petitioner is currently in med school, so not the best time to try to find a full-time job

What is your plan for the I-864 adjustment of status in that case?  If he/she cannot improve income or obtain a joint sponsor by then, expect it to be denied.

Using assets has a great chance of being disregarded. I can find dozens of reports on VJ when USCIS wasn't satisfied with the assets.

Without I-864 approval, there won't be GC issued.

That is what we thought! We do have added many boarding passes as we have been lucky enough to enjoy many travels together, along with accommodation reservations. I hope that all is enough and the RFIE is just about a box we forgot to check or something like that. We did not add the passport stamps as the beneficiary lost their passport.

 

We could just throw in the Petitioner's stamps to the country of the benificiary but it seems a bit difficult to show in one photo the stamp and that it belongs to the petitioner.

ahh ok, so it'll probably show up in the mail in a few days. once you get that you'll know what they are expecting. which is probably something like proof of meeting within the 2 years or the letter of intent to marry.

 

as for the finances, you have time to find a joint sponsor. unless the petitioner is able to get a full time job (again, i know that would be difficult in their situation) a joint sponsor may be the only choice

they should be able to tell, US passport pages look different than other countries passport pages.

you can also put the scanned image of the passport stamps in a word doc and write exactly what it is.

Yes, we are aware of that, but we don't know what else we can possibly try. As a worst case scenario, we could get it denied but waiting for the permission to Work for the Beneficiary and submitting AOS again taking into account the beneficiary income. Would that be possible?

Not possible.  The EAD will not be approved if the I-485 is denied.  You will need a joint sponsor.

without her name on account which requires a SS number or ITIN (which she is not eligible for since not married), you can not open an account for her without her physical presence in US 

 

for your purposes K1 is not the best choice as she will not be able to get green card and help with income until the AOS process is done on top of the expense for the AOS which on low income is very expensive 

 

You need to research cost of AOS after marriage and cost of health care insurance to satisfy the CO at the interview

It has been a while since I have done the K-1 visa, but don't you even have to submit the I-134 (Affidavit of support) during the K-1 consulate interview? I think it has lower requirement (100% of poverty limit, instead of 125% for I-864) -- but if MarioandMaria, you all can't satisfy that (and as others have mentioned, assets are a difficult way to prove it) you won't even get the K-1 visa for the foreign fiancé to enter. And say you do get the visa, the I-864 for the green card is an even higher limit, and probably more scrutinized since they are applying to be a resident (and not a temporary K-1 holder) -- honestly the worst case scenario is that you DO get the K-1 visa, but do NOT get the green card because of the I-864, because now the foreign fiancé has to leave the country or risk being out of status, and its a whole mess. 

 

You need to figure out a joint sponsor, or a job before the K-1 interview. Or put off the move, get married, wait until the sponsor is done with med school, and has sufficient income to sponsor a CR1 visa
