Hello,

 

I petitioned for my mom and currently she's AOS pending. I expect to get her SSN & EAD within 2 months.

 

She plans to work (as a masseuse) after getting her EAD/SSN, and I'd like to purchase insurance for her because she has to spend most of her time outside working. However, I read the latest information on the Healthcare.gov website:

Important update for DACA recipients & consumers with certain other immigration statuses
Due to a court order issued on December 9, 2024, Deferred Action for Childhood Arrivals (DACA) recipients and consumers with certain other immigration statuses listed below are no longer eligible for Marketplace coverage if they live in these states: Alabama, Arkansas, Florida, Idaho, Indiana, Iowa, Kansas, Kentucky, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, South Carolina, South Dakota, Tennessee, Texas, and Virginia. 
  • Adjustment to lawful permanent resident (LPR/Green Card holder) status without an approved immigrant visa petition

 

Does it mean my mom cannot purchase any marketplace insurance until her I-485 is approved?

If you live in the following states, then yes, as it describes unfortunately she cannot use the marketplace until having LPR status.

 

She could purchase insurance privately, or she could seek insurance via an employer.

Marketplace just makes it easier to see it all in one place, but a new immigrant isn’t usually going to qualify for anything like Medicaid anyway. You can go direct to the companies on there though. You can check online, it will depend on age, location, etc, but I’d budget somewhere between $1000 and $2000 a month.

Our experience in the last 2 weeks was that direct insurance was more complicated than it should be.  They seem to have taken parts of the healthcare law and applied them to non marketplace policies (ie - "Qualifying event" still required).  Both companies we inquired to (I have a separate thread on this) were also initially asking about proof of legal residency, etc. 
We did (fingers crossed) finally get one to open a policy directly but it took a lot of back and forth

Premiums were no worse than expected, no surprises there, though always depends on what you want.  The biggest nuisance was just getting them to approve someone in one of the listed states without an approved petition - it seemed to break their "mold".
