I am Japanses. My fiance is American. He is Active duty of U.S. Marine.

We are preparing for K1 visa.

Now I have a question. If I get married with him in US, when I enter US by VWP. and back to Japan in 90days. Is it illegal??

Is there difference to marry with Millitary fiance?

Is VWP can change status for Immigrant visa by I-485?

No, that scenario is perfectly legal.

Is there difference to marry with Millitary fiance?

No

Is VWP can change status for Immigrant visa by I-485?

To enter on VWP, marry, then stay in the USA and attempt to adjust status after having entered with the intent to do so, is visa fraud.

As pushbrk says, it's perfectly legal to entry the US on the VWP, marry a USC, and then leave before your 90 days are over. It's immigration fraud to marry in the US on the VWP with intent to immigrate and then file the I-485.

One thing to note - if you do get married, you will no longer be able to do the K1 visa. You would then need either a K3 visa or a CR1 visa.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
