Hello,

I've been living and working in the US for the past 10 years on an H1B visa, and my I-140 petition has been approved. I earned a Bachelor of Arts and a Master of Computer Applications (MCA) in India, and I have over 20 years of IT experience, specifically in software development. However, my credentials have been evaluated in the US (as documented in my I-129 and evaluation report) as equivalent to a Bachelor of Science in Computer Science. Evaluation was done by a professor from New Jersey's Science and Technology University in the US. Essentially, despite holding a master's degree, I'm recognized as having only a bachelor's degree in the US.

 

I'm concerned about recent news regarding USCIS scrutiny of job-related educational degrees. Since my master's degree isn't recognized here, I'm unsure whether USCIS will consider me as having a Bachelor of Arts or a Bachelor of Science in Computer Science (per the evaluation).

 

My question is: Given my situation, should I pursue another master's degree in the US for visa purposes? Or will USCIS be satisfied with the existing educational evaluation, recognizing me as having a Bachelor of Science in Computer Science related to my IT job? As master's is a big investment and time consuming, any advice or suggestions you can offer would be greatly appreciated.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

In cases involving foreign degrees, officers may favorably consider a credentials evaluation performed by an independent credentials evaluator who has provided a credible, logical, and well-documented case for such an equivalency determination that is based solely on the noncitizen’s foreign degree(s).[1]

In addition, officers may accept a comparable evaluation performed by a school official who has the authority to make such determinations and is acting in his or her official capacity with the educational institution.[2]

Officers should consider the opinions rendered by an education credential evaluator in conjunction with a review of the beneficiary’s relevant education credentials and other available credible resource material regarding the equivalency of the education credentials to college degrees obtained in the United States. Opinions rendered that are merely conclusory and do not provide a credible roadmap that clearly lays out the basis for the opinions are not persuasive.

Any educational equivalency evaluation performed by a credentials evaluator or school official is solely advisory in nature; the final determination continues to rest with the officer.[3]

For federal employment, the U.S. Office of Personnel Management (OPM) and the U.S. Department of Education provide guidelines on evaluating foreign education. They recommend that applicants submit their foreign credentials to private U.S. organizations for assessment, commonly known as credential evaluation services. These evaluations help determine if the foreign education is comparable to that received in accredited U.S. institutions.




In short, they might accept your professor from NJ or maybe it does not hurt to get the equivalency done from one of the evaluation companies mentioned above by one of the poster. Good luck.

The people to speak to are your Employers Lawyers, they are the ones who would know if this is an issue or not.
