Hello, I'm the petitioner of my spouse. I had previously divorced 5 years ago and I have my certified divorce papers that my spouse will bring to the interview.

 

On the embassy page, there is a checklist for interview. in one part, I am confused if they are asking for my(petitioner's) previous marriage certificate (not divorce)?

 

Checklist goes like this:

 

  • Birth Certificate: The applicant must obtain an original and translation of their birth certificate and those of any family member immigrating with the applicant.
  • Marriage Certificate: If you are married, you must present an original marriage certificate.  A certificate is required for all marriages, including those that have been terminated.
  • Petitioner’s Divorce Decree(s): If the applicant is applying for an IR1 or CR1 visa as the spouse of a U.S. citizen or lawful permanent resident and the petitioning spouse was previously married, they must provide evidence of the termination of every prior marriage of the petitioning spouse.  The evidence must be an original or certified copy of a final legal divorce decree, death certificate, or annulment papers.
  • Divorce Decree or Death Certificate: If the applicant was previously married, they must obtain evidence of the termination of every prior marriage.  The evidence must be an original or certified copy of a final legal divorce decree, death certificate, or annulment papers.

 

It doesn't say applicant or petitioner for marriage certificate, (but it spesific petitioner for divorce decree).

My spouse was never married before and obviously we will bring our own marriage certificate but, are they also asking for my previous marriage certificate?

They need your current marriage certificate (so the one with your current spouse) and the divorce decree from your previous marriage.
