Hello, I petitioned for my children I130. My US citizen spouse is filing for annulment and claiming marriage fraud. I gave a divorce decree that was not really registered and I was never questioned by uscis. Even received citizenship. Now I want my small kids here with me. Will their petitions be denied for this?

Did you list your kids in N-400?

I would be more worried about you staying in the

US.

That is odd they did not pick this up a common scenario.

 

Assuming you were not free to marry then everything else falls apart.

Oh man... I just read this carefully.

 

Yes, you can be denaturalized.

The best thing to trigger denaturalization is filing for kids overseas.

 

You chose a really bad path here committing fraud. It will probably haunt you for the rest of your life.

What do you mean ‘not really correct? Was it from official sources but just had a typo or something, or was it fraudulent?

The whole history may be revisited under current administration, and for sure if OP files for kids...

It’s all a bit vague but obviously makes a heck of a difference if it’s dodgy/misepresentation in any way. The OP needs to forget about petitioning their kids, as Boiler said that’s the least of their worries. Sounds like a really good lawyer is needed.

Why would filing for kids trigger it? Also, what are the odds that uscis is really hearing what she says and taking action?  I want to bring my kids from Nigeria. The American is mad but it is also my and my children right to be here in the land of free.

I have already petition for my 2 small children in Nigeria.

If you're a citizen, you must have been married to USC for at least 3 years. Having small children elsewhere puts legitimacy of that marriage in question.

It doesn't take a rocket scientist to spot a fraud in this scenario...

Yes I became citizen after 3 years.
 

But the American wife soon to be ex put my children on my initial petition in the i130 when she first filed for me.  She knew about my small children at the time.
