Withdrawn K1 petition from a prior relationship

So I am currently in a relationship with this girl and we are talking about getting married in the not too distant future. She had a prior fiancée apply for a k1 visa for her, but they withdrew it following a breakup.

We're just a bit worried that she may face difficulties now for another K1 since a prior one was withdrawn prior to processing. Any ideas on if this situation could negatively affect us?

It may cause additional scruitny from USCIS and/or the Embassy. It should also trigger extra scruitny from you. (Not in a bad sense... you just need to be aware because your girlfriend will have to be forthcoming with the embassy about this once it comes to the interview stage. She should be completely honest with you about it as well). It should not be cause for denial unless there is more to the story than it was just withdrawn following a breakup.

I'd have to assume that the more to the story would be like if she cheated on her prior ex or something along those lines?

So I'd think the infidelity question would be an issue more of concern to you. The concerning part when you get to the embassy stage is if the ex withdrew the petition and ended the relationship because he discovered issues from her past that would cause her to be inadmissible to the US and thus be denied the K-1 visa at the interview.

Or if he withdrew the petition because she was scamming him.... Or if she was not eligible for a K-1 visa (not legally divorced from a prior marriage for example)

Usually the issue comes in if the USC did not actually withdraw the K1. Yes they expire but over the years I have seen more than once that it still causes problems at the interview.

 

Get to know each other and take one step at a time.

Not yet, but gonna meet up later this year in Turkiye.

But reasoning for the withdrawal was basically that he thought they werent compatible and broke it off. Nothing more really to it
