Hi,

 

My son has been married since April 2021 to a USC. He received conditional residency on May 25 2022. They applied jointly for ROC in March of 2024 and they are waiting.

Is he eligible apply for citizenship and if so by which date? TIA

He can apply on February 24, 2025 or later. I recommend filing on March 1, 2025.

 

He can do it if:

- He didn't have any trip longer than 6 months since becoming resident

- He lived with US citizen spouse for all 3 years since becoming LPR

- He spent over 18 months in the US in the last 3 years.
