Hello everyone, will there be a problem if my Bf did not pay his taxes for 2 yrs, he only works seasonal in nantucket as Line cook.. And our Plan is since they offer free housing where he works I will stay there, and we can rent the place continously once his season is than the restaurant he's working with.. I am thinking how hight the chances we will get approve or if our plan will works. We are only doing our stuff DIY and searching.. Thank you.

Has he just not filed his taxes, or has he not paid them at all.  Both are issues in different ways.

 

If it's the latter, he needs to pay his taxes.  At which point, he needs to figure out if he made enough to require a return being filed.  If he didn't make enough, no issue from a taxation perspective.  But that will create immigration challenges, as its HIS responsibility to support you and him, as none of us want to be left footing the bill and USCIS will make sure we aren't.

Not only does he have to file tax returns ,  he must include the cost of the housing as income if he does not pay rent

HE needs to file a support document with his income to show he can support u /usually also show tax returns and if he owes ,  pay it completely 

if he does not make enough he needs  a joint sponsor

 

nothing wrong with seasonal work,  if is enough to sponsor you

property guidelines for K1 are 100% 

125% for spouse

125% to adjust status to LPR after the K1

cost of adjusting is over $2000 for your work card,  AP so u can travel outside the US till EAD is approved 

u can can work till the AOS is complete and u have SS # and work card

Hi, He told me that although he works seasonal in nantucket, he will the meet the income guideline for 2 households. Should we get a lawyer instead? This is just difficult to understand sometimes. He said that he will get a tax returns. But actually, Idk how we will start and when or which to start, can anyone help me or a guidelines.

There’s a great guide at the top of the page. But he needs to sort his taxes as the very first step, get him to focus on that and then you can start the process to get you over to the US.

Yes, my Fiance.  Well, that what I was thinking, he will be paying a lot of things once he started working and I am afraid if it is the time for my interview and he won't have enough money . His work will start on May - October, if we submitted our K-129 Packet it will surely take more than 7- 15 months.

You say above he meets the income requirement though? If he doesn’t then you’ll need a joint sponsor. But get him to sort his taxes first and then he’ll know exactly what figures he’s working with.

Also, nothing to do with the visa, but you mentioned living in Nantucket - it’s a beautiful place but incredibly isolated, particularly in the winter when so much shuts down. Maybe he could look at getting a full-time job elsewhere? I just can’t imagine how tough it would be to move to another country and then live somewhere like that.

You do not need a lawyer/ fairly simple to follow the guides above or on USCIS site to petition for u

BUT he needs to file those tax returns and if he owes, they have to be paid 

7 months to interview?  No ,  it will be more like 18 months or longer so he has time to file and be ready

Nantucket can be isolated in winter but it is also very beautiful /its a community of artists with several shops and good restaurants and you will see the whales when they migrate back

the isolation is welcomed after the busy tourist summer season when all people in Nantucket just want the tourist to leave them to their beautiful island
