My attorney said to keep her mail and offer to give it to her. She still has some things left behind (though she hasn't made an effort to pick it up). As per advice of my attorney, they are all stored in boxes. The attorney said do not get rid of anything until the divorce is finalized.

When you X out her address on her refused mail, also mark out the bar code printed by USPS at envelope bottom.  Sometimes, refused mail will come back to you again because that bar code gets read.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I disagree with your attorney completely, she should have changed her address with USCIS (it’s a legal requirement to do so) and if she hasn’t then tough luck on her. Just return to sender anything from USCIS, then USCIS know she’s moved without her telling them, and you don’t have to be in contact with her either, so a double advantage. 

I agree with you. All letters should be returned to sender including USCIS mail. It's not OP's burden to collect and store mail addressed to somebody who doesn't live at the address.

Hello everyone! Thank you so much for walking with me through this mess. There aren't enough words to describe how much your advice and encouragement are appreciated. As an update, let me say that she showed up to meet me at my lawyer's office where she signed the divorce papers with the notary present. After signing the papers, she has tried to meet up with me. I told her no I'm not interested. She has been blocked from all communication except one (a phone line) and the only reason I left it open is for her to get her things. The divorce papers are signed by both of us and the only thing left to do is to have a date scheduled for the judge to sign off on them.

 

My Concern:

I discovered that she is now stalking me from across the street. She sits in her vehicle watching my house. And last night, I had a friend over where we with my daughter were watching a movie relaxing at home and she showed up out of the blue to pick up her things. I asked her to come back later because she was interrupting my evening. She was adamant about getting her things at that very moment. She was alone and the positive thing is that I had two witnesses there (my daughter and a friend). I will be contacting my lawyer. She texted me today to say that she hopes I'm happy and will never be back again.

Sounds like she is still working on the VAWA claim....or she has found another target.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Can you get a restraining order?

I'm not sure what you mean by working on a VAWA claim.

Use your doorbell camera or peephole to screen who's there.  If necessary, talk to her only through the closed door -- do NOT open it even a crack.  Inform your lawyer and follow the consequent advice.  A restraining order may be prudent.

Wonderful -- congratulations!  The weight of the world is lifting off your shoulders.  Handle the residual part above and there'll be no stopping you during your better life ahead.

I mean that she will possibly leave you alone now.  Maybe she is pursuing a VAWA claim against you (she won't need you any more).  Maybe she has found another possible marriage partner to help her get that Green card. Maybe you have served your purpose.  If you haven't already, get her stuff back to her through an attorney.  She would no longer have a reason to contact you again.  Hopefully, you are free.

I checked in the UCSIS site and the application has not been withdrawn as of yet. I sent the withdraw request in January. It says...

You have done what is needed to withdraw the I-130.  The divorce also halts the petition since the relationship will no longer exist.
